» am chair make a motion that we adopt the agenda as presented hey motion to adopt the agenda as presented is there a second madam chair i'll second okay mr tomlinson second um i actually have an amendment right i make a motion that we remove item 9b so this matter actually failed the first reading and it was inadvertently carried over to this agenda and i did not catch it i also make a motion that we remove item number seven um miss samantha gum is unavailable tonight so removal of item number seven public presentation and removal of item number 9b okay second from mr shoemake any discussion on those removals speaking about the young farmer and rancher association so she did want to let folks know that it's something that she couldn't get out of that she had to miss no problem put her on fut
» ure agenda yes repeat the remove uh removers again one more time number seven public presentation miss gum is unavailable so we'll put her on a later agenda and then remove agenda item 9 bravo the second reading of case 2313 so that ordinance actually failed the first reading so it shouldn't have been carried over any other questions okay um all those in favor of the two amendments the two removals off the agenda indicate by raising your hand and the vote is unanimous we will strike both those items yes mr tucker okay amendment to add an item this item amend the agenda to add a new new business item for approval of funding uh to the santee lynch's council of governments to replace um a generator on the council of aging building and it's not replaced but to reposition it because they have pu
» rchased it so it needs to be repositioned okay mr tucker you'd like to add an item under new business yes ma'am council of aging generator yes ma'am it can come after the first item of new business or before whichever one you do you need necessary all right there is there a second to add that item to the agenda i'll second okay mr cato with the second and any discussion yes ma'am just for the urgent circumstances i would just like to state that um this is uh for the council on aging which is our older population they have a generator that um has been purchased by the cog but when it was connected and all that it was not assembled in the right spot due to some property lines and also um not being in best position for safety wise so this needs to be repositioned if we do not address this toni
» ght it will probably be 30 or 45 days before this is done and we're already into hurricane season so this is the reason why we want to address this tonight and move it forward madam chair okay no problem any other questions on that addition right all those in favor of the amendment to add an agenda item to new business indicate by raising your hand and the vote is unanimous mr tucker let's add that to c charlie council on aging generator yes ma'am all right and any other discussion on the agenda okay all those in favor in adopting this agenda as amended indicate by raising your hand and the vote is unanimous this is our agenda as amended all right up to public comments thank you right there are two public speakers this evening the first speaker is tom webb the third hi tom this little bookl
» et i have here uh contains the declaration of independence the basic constitution and all of the amendments up through uh 27 i think a lot of people think that the constitution would be as big as encyclopedia britannica but the the constitution was written on one page one page rather closely spaced one page our constitution united states constitution um but some of the states would not have uh accepted it except that they put in um the bill of rights the first ten amendments to protect the states from overzealous central government and the people so um cresconda torres is on fire for the constitution and she's going to be presenting uh videos there are six of them uh starting the first one will be thursday september the 28th and the meeting will be at uh the patriots coffee shop down on bro
» ad street uh 7 30 p.m so there'll be six of them one a week and uh and if we get if she gets some interest and i'll probably be there uh i've got to project her to show it um if there's interest we'll we'll do it again and again and again but uh it's something that so many people have little idea about they think that is it's so so stilted that they wouldn't be able to understand it if they read it but it's just in plain english um very helpful to have somebody explain it though so that's what the videos will do um i've seen them there's about 40 minutes on average for each video and there'll be time afterwards for questions discussions and um and um try to bring some more people in hope that we can have a good size group uh see look at my notes um i believe that's uh that's about it but i
» just uh would invite anybody who is at all interested especially in being in any kind of form of leadership that you need to know what's in that constitution um there there are volumes that can be written about it but the actual constitution is fairly simple and we can understand it so please show up that'll be uh september the 28th thursday 7 30 p.m patriots coffee thank you thank you mr webb the next speaker is chris renfro hi chris howdy i'm not as fluent a speaker as mr tom but i figured we'd do this as a warm-up before we get to the public hearing just wanted to thank everybody for the especially the council for looking into this uh means a lot and during public comments looking forward to sharing my side of the story and what it means to me and again thank you all for looking into it
» all right that concludes our public comments thank you mr renfo all right item number six a series of public hearings for different cases excuse me the first case is going to be 23-16 this is amendment of section 3 3.5 of our zldr to allow rv and trailers to remain nine cumulative or consecutive months per year and provide procedures for operators to main guest registries we'll open the public hearing now and the first speaker is chris renfro getting my steps in mr renfro i'm sorry um we're on item number c not number charlie okay yeah i know everybody so c 23-16 uh yes sir okay okay and i want to give you all some pictures here i only made one copy so it's got to be passed around can you grab that and i just want to explain these pictures and what they mean and kind of walk you through the
» process of where it's taken and how it's went to get us to where we are now uh as that gets passed around page one is a picture of where we started kind of general outlaw of everything and you can see we did some hydro seeding uh i'm the sole income on the project i don't have any investors i haven't taken out any loans it's very hard in this industry so everything's got to come out of my pocket and be worked for and on top of everything else that campgrounds have to go through with the county there's different agencies involved with how campgrounds operate and what we can do and how we can do it uh one of the big ones being dhec and so just from that first picture you wouldn't be able to tell but that's over twenty thousand dollars in grass water etc to meet my commitment to stormwater per
» mits and if you look at site number two on page number two you can see our family getting together building this thing power meters we did a lot of the work that we could do ourselves uh such as wiring the internet all that other stuff to try to save a couple bucks because we know how to do it uh page three is just kind of some of the progress that we've made you can see it on our facebook page get more involved and you know finally we go to page four uh just want to make note we started this ordeal in march of 2021 with the county and we were not able to open our doors until june 30th of 2023 and still to this day have not made a dollar made anything off of this business but page four shows you kind of the progress and the steps that we took uh and the very last page we're finally open we'
» re excited to be open we plan on doing a lot with the community and the travelers we meet the needs of a lot of transient workers uh so we definitely have to have more than three months to help those people out they're not staying in hotels that most of these people like to sleep in their own bed and what better bed than your camper your second home in most cases and so we have a lot of people coming through right now i would say our park is 80 percent full of transient workers nurses here in kershaw county um make up a good majority of them also we have four to five people in different sites that are working on international paper for maintenance and in vista right now with our different industries that are nearby as well so it's it's it's more than what meets the eye um and i'm here the r
» est of the meeting so any negative any pros any cons i'm a big advocate of the nine months or you know just doing without it i have case examples from different counties and their regulations and what they have in place uh i probably i'm not a expert by any means i just want to make sure we're making the right decision even though this does benefit my business just making sure it's the right decision for the county as a whole so i probably invested 120 130 hours in this research to make sure it's not a selfish and it's good for the county so i'm here if anybody has any questions as well any questions for mr minfo if possible madam chair once we get to discussion i may have questions depending on what okay when we get to the agenda item okay thank you all right the next speaker is hirgin mat
» zel mr matzel did i say your name right yes okay yes good evening everybody good evening um my name is hirgin mutzel me and my wife we own watery lake abbey park uh the park was established in 1999 and we heard about the three-month rule mr matzel microphone a little closer to your mouth we heard about the the three-month rule maybe going to a nine-month rule or even take the provisions away altogether and we just wanted to take the opportunity to give some insights about our campground business what we've seen in the last couple years what changed especially the market market conditions since coveted in 2020 so in our opinion it is necessary to remove the three-month rule altogether and have no limit on monthly stays and here are some reasons i'd like to just bring up a couple reasons why
» we think that first of all i'd like to explain the different type of campers that are out there that we've seen in the last couple of years and that was that's what usually typically is for other campgrounds as well depending on where you are whether you're a destination campground or um just basically where where you are closer to the beach closer to water closer to attractions whatever so there's number a full-time campers who use their camper basically as their primary home they travel the united states they usually stay anywhere between two weeks to 12 months usually they don't stay like forever because they just like i said they travel from one campground to the next one and then they just move on then we have number b we have the workers who use their campus for temporary extended sta
» ys because they either can't find anything else or they just feel more comfortable in their camper and their stays are usually between three to 18 months i would say then we have the weekenders who'd like to have basically the campground as a kind of a weekend getaway holiday getaway they'd like to park their camper at the campgrounds for an extended period of time they usually come only on the weekend sometimes during the week for a few days go fishing i mean it's really just recreational activities and then we have the transient campers like the weekenders who are usually just staying for two nights three nights maybe sometimes a week but mostly what we've seen it's only two to three nights at the most usually they check on friday they check out sunday so those are usually the four type c
» ampers you see in in the campgrounds depending on where you are so the first reason why we think there shouldn't be a limit on the monthly stays is as i said earlier camping changed over the last few years especially with covid a lot more people looking for temporary lodging could be one month three months 10 months 18 months you you don't really know with that being said we've seen from our inquiry forms we get for for the monthly sites there is not enough lodging available in that area because we have so many workers travel nurses teachers engineers gold mine workers etc our camp or inquiring our campground because they are either in the process of building a house in the process of buying a house or they just can't find anything and they are just trying to to get a place somewhere to sta
» y for x amount of time for during their work assignment basically and we believe the situation won't get any better because with the new scout plant opening up in blightwood in 2026 there will be a lot of people coming to that area and they need they need places to stay and i think it should be at least a way for them or for us that some of them can find a place to stay even if it's a campground for and i'm not saying that we want to fill up their camera with 75 campers or 75 workers but here and there it might be it might make sense to just bring a couple people in to help them to get situated when they move uh to the to the county so the second reason and that's i mean in my opinion that's one of the most important ones that's i believe that campground owners should have the ability to ad
» just their business to changing market market conditions because right now the camping camping is booming it's really booming i mean we have so many weekenders people who are asking they want to have a good time at the lake but i mean it could change in a couple of years and there might be someday that we have to take in more full-timers or more workers for a couple a month i mean you never know but we should have the ability to to pick uh people if we if we can't find any or if like let's say if the park is half empty i mean it will just make no sense and the third reason especially for chris campground new established campgrounds same thing they need to have the ability to get their business going to get the word out and there shouldn't be a limitation on how long people can stay i mean j
» ust one example let's say a worker stays at chris campground and he has a six-month contract even if he would extend it to the nine month what if that contract isn't fulfilled after six months he has to stay 12 months we want to kick him out i mean i mean the word will get out and they spread the words those workers and he will get no business no more i guarantee you they did those people they all talk that the people that are on the road they all talk to each other i just think that we should have the flexibility if someone wants to stay longer he should be able to stay longer and the last reason um our busiest time is and that might might be a little bit different for chris but our busiest time is from april through october and in the off season if we only rely on on weekenders our campgr
» ound would be empty i mean really empty and if you want to see the reservations from last year through the winter on the week for the weekenders we had almost zero so we we need we need the monthly get throughout the season through the off season as well and another example let's say uh um someone checks in october we have people they want to fish through the uh through the summer sorry through the fall through the winter and sometimes through the spring so they stay for a couple of months what if they like it what if they like the community and i'm going to tell him in march hey sorry uh now you have to you have to pull your camper out i mean at the end he just wants to have a good time he no one lives there they just want to have a good time at the lake they just want to enjoy it they jus
» t want to have a good time that that is our approach and um that's pretty much all i wanted to say yep thank you can you state the name of your campground again i didn't catch it watery lake abby park and marina watery lake thank you and i have some pictures if you want to see some pictures from our stuff what's going on with activities i mean we have corner tournaments we have golf cup rates we do we have a nice beach area where people can swim and fish and i mean we have a really great community at our place and even the locals are heavily engaged in the whole campground community community it's not just the campers it's the whole area the beaver creek area so it's it's really a good thing yes sir thank you approximately how many of your campers because you guys have been around for some
» time the park has approximately how many of your campers are full-timers like people who stay year to year like how many people in your park now have been there for multiple years we we don't have any full-timers who live at our place like zero we usually if we have someone asking us um hey we want to move to your place we want to live there we said nah we and we we don't want that ourselves we tell them you can stay three months that's it that's our three-month rule what we do we we don't want any full-time people living at our place and we tell them you it's not a permanent residency it's it's temporary we have two workers left we had a lot when we when we took over a few years ago but they we all tried to get them out and we have a few left they are here for maybe close to a year or so b
» ut their contracts are basically expiring very soon and work is usually anything like i said between 12 to 18 months i mean there are workers who who stay on a three four-year project we we haven't seen that yet and and the rest of the people are basically weekenders they they park their camper for an extended time but they they pull them out for a week or two to go to the beach they come back they put it down they they come mostly in the summer they are sometimes here in the winter but depending on if they like to fish um other than that i mean that's like i said 95 percent weekenders they are here on an extended stay they leave their campers there but they pull them also out bring them to the dealer bring them to or go to the beach for a week or two or even some i mean we have people they
» pull their campers out for two three months and then they just came back and i may have some questions when we get to this part of the agenda i was just curious about that thank you madam chairman i have a follow-up question yes just a quick question to follow-up on councilman she made a question do you have a period of time so you said three months is normally your policy do you have a period of time that you tell um a person who's staying in the campground hey you've been in the three-month period you have now two-week window where you have to go somewhere else to before you can come back is there a median kind of time frame that you're looking at there no we usually when we know that someone like when we get full-timers and they tell us hey we are full-timers they we want to live there t
» hen we tell them before they check in okay three months that's it i mean your checkout date is so you give them a three-month window where they have to check out however if they want to come back a month later you give them the opportunity to come back or you don't see as many coming back we don't see that because usually they just move move to another campground usually longest if someone really wants to live at a campground they want to live there forever and we we we just don't want any permanent residence okay so you try to prevent somebody staying for a longer term period in three months is where you you feel you get your benefit we tell them you can come here but you have to after three months that's it okay thank you appreciate you thank you sir all right any other speakers for the p
» ublic hearing for case 2316 all right i'm going to close this public hearing and i'm so sorry gentlemen that i went out of order this however they were handed to me so now we'll go next public hearing will be alpha the industrial park an ordinance authorizing an amendment to the agreement for development of a joint county industrial park by and between kershaw county south carolina and fairfield county south carolina to expand the boundaries of the park to include real property and other related matters if there's anybody that would like to speak at this public hearing please approach the podium okay i'm going to close that public hearing the next public hearing will be case 2315 an amendment of the stormwater ordinance number 258.2015 if anyone would like to speak at this public hearing pl
» ease approach the podium all right i'm going to close that public hearing public hearings are closed thank you to the citizens that signed up to speak this evening item number seven we struck out item number eight approval of minutes from the tuesday august 22nd regular meeting is there a motion at this time regarding these minutes i would move to a motion to accept the minutes as presented i'll second councilman she makes motion mr tomlinson second any discussion once again fabulous job by miss hannah all those in favor of approving the minutes for tuesday august 22nd indicate by raising your hand and the vote is unanimous those minutes are approved item number nine ordinances first a third reading an ordinance authorizing an amendment to the agreement for development of joint county indus
» trial park by and between kershaw county south carolina fairfield county south carolina to expand the boundaries of the park to include real property and other related matters is there a motion at this time regarding this ordinance so moved okay mr brazil makes a motion to approve is there a second i would second mr shu makes seconds any discussion any new information from legal no madam chair um just for the record uh these mcip agreements require that both counties pass an ordinance um fairfield county's ordinance is tracking behind kershaw counties but it passed unanimously last night at the fairfield county meeting okay councilman okay may i say something um just just to speak on economic development in general i think it'd be good good for us to to say that kershaw county is indeed ope
» n for business and uh look forward to working with anyone whether it be a neighboring county or um in any any new business coming in the kershaw county we are we are eager and uh willing to work with with anyone on any level so thank you yes thank you mr brazil and we thank our colleagues in fairfield county for um working together and expanding this as well yes sir can i ask mr dubose yes absolutely when will be their third reading and final reading their um council meetings are on the second monday of each month so i believe that would be october nine if i'm not mistaken and they only meet once a month right um i think right now they are meeting twice a month but i could be mistaken i do know that their second their third reading will be at their october meeting october 10th thank you tha
» nk you mr tucker welcome all right all those in favor of the third reading of an ordinance authorizing an amendment to the agreement for development of the joint county industrial park between kershaw county and fairfield county indicate by raising your hand and the vote is unanimous this passes third reading all right we're up to charlie second reading of case 2315 an ordinance to amend ordinance number 258 no okay no that's okay thank you the amendment and restated kershaw county stormwater management ordinance to clarify that kershaw county does not have mandatory monitoring and enforcement responsibility for permits issued by the south carolina department of health and environmental control outside of the small municipal separate storm sewer systems sms4 and to clarify the responsibilit
» ies of the stormwater manager is there a motion at this yes mr tucker i'd like to make a motion that approve uh case number 2315 on the store that's okay mr tucker makes the motion to approve is there a second i'll second okay mr tomlinson second and into discussion mr debose if you'll just give us a brief i know you did at the last meeting um but i wasn't here kershaw county's enforcement and monitoring responsibilities outside of the sms4 kershaw county is responsible for monitoring enforcement of dhek permits in the small separate municipal stormwater system um that is the urbanized area and suburbanized area of the county um elgin into uh i guess parts of lugoff um over time through uh as populations grow those sms4 areas do grow within counties but um essentially kershaw county has to
» assure that dhek stormwater permits are abided by within that um geographic area if it does not kershaw county was actually responsible for those violations and deficiencies on those permits um this ordinance uh stormwater ordinance was originally drafted to assure that kershaw county was in compliance with its enforcement responsibilities in the sms4 however um the the verbiage in areas is is fairly broad and mandatory and the ordinance could be read the past ordinance to impose some kind of mandatory enforcement monitoring for permits that dhek has issued outside of that area um that is not the case uh kershaw county does not have to enforce and monitor those permits so it just makes it clear uh that said um it does not prohibit kershaw county from bringing enforcement actions outside of
» the sms4 if there are um stark issues that the county needs to act on itself um that aren't being addressed it it certainly could but it is not mandatory um that it do that and um the typical mode for most counties is to notify dhek of of of issues uh with dhek permits outside of sms4 areas so dhek can address them county has finite resources finite manpower to address and monitor these permits so um this just clarifies that okay thank you and this might be for mr templar who is considered our stormwater manager um right now we have our our engineer steven staley handling everything out there thank you both any discussion questions um thank you for putting this together mr debose we do need to clarify this we've had a lot of issues with our stormwater management in neighborhoods especially
» all right with that said all those in favor of the second reading of case 2315 indicate by raising your hand all right the vote is unanimous this past second reading we'll have it on the next agenda for third okay delta second reading of case 2316 in ordinance to amend the kershaw county south carolina unified code of zoning and land development regulations to amend section 33.5 to allow the maximum permitted time of stay for recreational vehicles or trailers and camps and recreational vehicle parks to be nine cumulative or consecutive months per year and provide procedures for operations to maintain guest registries is there a motion at this time i would okay motion to adopt is there a second second second by mr tucker into discussion yes absolutely okay mr debose if we were to say there's
» no no restriction can you talk me through generically what what what impact would that have if any on sort of tax issues and things like that if we said okay there's no there is no time frame what kind of impact would that have if any yeah so you know these rv parks and campgrounds are taxed as a business they're operating as a business um have these temporary um stays by campers uh if you had a um person staying in a campground indefinitely and permanently as a resident they wouldn't necessarily be paying advil warm taxes commensurate with the load that they place on county services um furthermore a a larger policy concern and taxation concern would be if those permanent residents of a campground had children that were in school again you're not collecting uh adequate advil warm taxes to u
» m reflect school-age children um in these in these permanent resident camper situations how is that different let's say because the question's been posed to me how is that different if any and maybe it's not from say an apartment the owner of an apartment building is that similar um you know i don't know i'd have to dive into the particulars of that um and get back to you on it yeah i think one one issue i would think just off top of my head is that typically when someone moves into an apartment they're going to typically register vehicles here and sort of establish a domicile as opposed to rv park where that camper could be registered out of state all the vehicles so it'd be harder to keep vehicles registered out of state so um and i'd also be curious if i could madam chair to ask uh mr re
» nfro and uh the rv uh the what are we rv park folks the question i'd have is if we did have a number what would that number be if not indefinite because i heard some numbers about 12 to 18 months and so like what all right obviously i know that the thought is well no restriction i understand that we're having nine months if if you had to have a restriction if you guys wouldn't mind coming up but my question would be if you had to have a month time frame of restriction what would you recommend as something that would that would balance the needs of your business with those issues uh that the county attorney just mentioned and maybe the answer is there is no balance it's it has to be unrestricted i mean i think it's not so much about us just a certain month i'm just worried that no matter how
» long people stay i have a hard time just telling them hey sorry your time is over you have to get out because if people even if it's worker if they come here they rent an airbnb they can they have monthly stays they can stay as long as they want and that's what they're going to do probably and or hotels i just and like i said again most like 95 percent of our people are using it recreational only we don't have anyone live there i wouldn't want to tell a family who's who's here on the weekends and just uses our facilities hey do you have three more months after that sorry you have to leave i don't know can i get chris the reason i yielded to him at first he's been in business longer than me so i do i couldn't give you a good guesstimate on what would be biggest but i do have a couple comment
» s about what the attorney said if plausible so we are one out of what sorry we're there's eight counties total out of 48 counties in south carolina 46 46 46 my bad that do the education tax is called ed cap that we pay into every month with our business as well and from my understanding as it's written most of the school education taxes come from businesses it's not the millage on your you know personal property and i understand taxes are important but just thinking of the everyday american customer so much of what we buy is hidden in these taxes yes we go to the store we pay an eight percent tax but we don't know all the other taxes for the products that we're getting for example a customer that comes to my business their one dollar is only worth 52 cents because 12 comes off the top to pa
» y for all these different programs and some of that money comes back to this county that's off the dollar that's not after what's left over a power everything else we're just talking one dollar so my customers dollars only were 52 cents after paying the sales taxes accommodation taxes and everything else when they come to this county my tax as a campground owner is around 62 cents before that's what a dollar amounts to for me as a campground owner so that dollar is now worth 62 cents roughly and that's not even counting in south carolina personal property uh it's a tax that if you own a business your business can't own a chair so you have to pay taxes on that chair till it depreciates out that money also goes back into the county um and to the school thing agree 100 percent i mean i get peo
» ple that do call me on that issue but uh even though millage makes up a very small amount i don't i just tell them if they're in public school you know i feel we have a need right now for new schools and all this other stuff i don't want to get into but you know you can't stay here but if you homeschool perfectly fine but again that's kind of power to the business owners and you know i wasn't necessarily for unlimited stays to be honest because what i've seen was nine months would be pretty good but he did bring up some points i have two workers that have no idea they should be done january and if nine months passes they have to be done by march from when they came in and if that project takes longer than you know the next allotted two months of this ordinance then the issue comes into play
» where do they go because there's a reason they're at my campground as well because everywhere else is kind of full in our surrounding counties and our county here already and to my recollection i'm the only forgive me for saying it idiot to open a campground in kershaw county since the ordinance um so that's why i do appreciate y'all looking into it um and i do have here if you know again i'm not an attorney i don't have that degree i'm just a man with google and a lot of research um but there are a lot of other counties that i have here that just simply don't have the three-month rule at all um just to be transparent richland does have of rule 30 days uh but a lot of the other counties around us they don't have anything in there and pretty much when we did this ordinance i think it was 201
» 2 or 17 somewhere around there where three months was added in that's the only thing that was changed so if you look at all these other ordinances i have pretty much the only difference in ours and theirs it's just the three months was written in but if we do because i want to think about the county first and making sure you know we have other business owners that might not be as responsible as me and ergan here right so there are some other rules they put in place to give county a little bit of power and say so to make sure we keep these campgrounds beautiful as well like is our intention um chris and hergan thank you how long do you require people to leave before they can come back so they're there three months and then they leave a night and then they can come back for three more months
» the only way that as the county code is written that we can allow anything like that if they came in three months before the end of this year they could stay another three months into the next year but then they have to they have to vacate this based upon a fiscal year is that yes okay yeah based upon the cat well the guy our calendar year from coming in okay yes sir and can your um campers get mail okay they can get a po box okay no no mail just if they want to receive mail they have to sign up for a box okay there's no address there though there's not getting any mail or okay if i may madam yes mr tucker so just to give you a little history on where the three months came from because i was one of the ones that's sitting up here uh it is state law that uh once you move from one state to an
» other that you have your vehicle registered within 90 days so so that makes more sense so he was talking about the apartments not long ago but apartments pay more taxes because you got a physical structure um and you got a lot of people and they will register their vehicles into the county that they're residing in so this was some of the thought that went into the three months um i'm not for unlimited i can tell you that now but i am for um trying to be accommodating and give you a little bit more space but it sounds like you guys are doing a good job policing yourselves it doesn't seem like it's a problem but i think we do need something on the books so people won't just look and say oh kershaw county's unlimited let's just move from park to park because there's nothing to say i can't stay
» three months with you three months with him and three months with another one and then three months with another one and i ain't paid no taxes yet on nothing other than gas for moving so that's where i'm at and i think one of my colleagues may make an amendment or something or um but i am for trying to have some type of structure of time thank you mr i just wanted to add our our campers are 90 probably from either lancaster county or kershaw county don't have like i said we have two three workers and the rest are already in south carolina and they are from that county we don't have people from all over the united states no so i'm um i mean i am partial to changing the language that they can't be there permanently and letting the business owners police their own residents or police their own
» campers that you guys are doing a great job and you know best about this um i don't know if i agree mr tucker respectfully that we as the government policymakers need to be telling people how long they can stay anywhere with their situations with work transient work or contracts like you said travel nurses building a house that can take a while so you guys brought up some great points um i would be in favor of extending the nine months or removing the restriction altogether i think mr tomlinson okay mr brazil yeah now i'll yield i would like to offer an amendment so um i agree with mr tucker it can't be um unlimited because an rv park is not meant to be a full-time residence and that's the issue i think he has um i'd like to make an amendment to change it to one year um that that basically
» gives them the opportunity to stay even in the second year but i think there needs to be some sort of documentation or inspection yearly that the county would work with you guys on um keep it as simple as possible but we just don't need an rv park becoming a full-time residence we don't want that either and mr brazil um in the actual ordinance yeah bravo it does state the registration of occupants and i guess it gives them guidelines of how they're gonna determine dates of stay i'll second mr brazil okay motion to amend the ordinance you strike nine cumulative or consecutive months second and change it to 12 yes a calendar year right so he said here i just want to be clear because are you is your motion to amend to say a year to say 12 cumulative or consecutive months because if you say a y
» ear if they move in in march what does that mean 12 months does it mean the rest of the year i think that would be one year from the date they moved in right yes yeah if we want to structure the language that way i think that'd make it crystal clear okay because you don't want to move in in december and they gotta move out the end of december because we're starting a new that wouldn't be a year or 12 months all right and second by mr tomlinson yes discussion we're still on the 12 months the amendment of 12 months so address as well in terms of an intent is some of the rv parks and i'd be curious to hear you're in your thoughts on this so so from talking to some of the other rv parks but there aren't many there's about five is that rubber yeah so so some of the rv parks under the impression
» that even the the old 2017 ordinance they're grandfathered in as a campground so in other words if you have a campground that existed before the 2017 ordinance you can continue to have people come in and stay indefinitely and so i just want to be clear that the way the ordinance even as the 2017 ordinance read was three months it doesn't have it doesn't have anything exempting so the way i would read this is it's certainly logical under a fair reading of the law to say anybody that was living there before this ordinance can continue to live there because they've established you know a right but anybody who would leave would be would be uh subject to the ordinance so in other words if you have a campground that existed in 2015 and you have a resident that moved in in 2015 and that resident p
» lans to stay they would still be able to stay because they would be grandfathered in because they're before the 2017 ordinance but if somebody moved in and you know next week to a campground that existed before 2015 that person couldn't stay indefinite and i just want to be clear and i just want to make sure just to ask this body if there's any disagreement about that interpretation because i just want to be clear and and i want to ask you especially you juergen did is that is that your understanding of how the ordinance reads in terms of the way you guys would look at it well to be honest not really i mean we were under the impression that we were grandfathered in however we we never really took it to that level that we took people in and let i mean when we took over there were several peo
» ple living in that campground and we all kicked them out because we didn't want it so we have truly people don't live here but they have their campers set up yep i mean it's a difference they don't live there the campers are set up year round but they do not they only come on a weekend maybe every other weekend sometimes they are not here for two months you don't know they just use it as like a weekend getaway yeah and that's okay and that's like a seasonal type thing well and so that's one of the reasons that and that's why i want to bring this up as well and i don't know there's something we can address on second reading but but we definitely need to get to it before third because the point you're going just made you know the ordinance says that no trailer vehicle can remain in the park f
» or more than if this amendment passes 12 months but in juergens park there are vehicles that stay there continuously because in juergens mind he's grandfathered in and i understand i'm not attacking what you were maybe told but that's a problem and i think if we're passing this new ordinance we need to be crystal clear and maybe even have planning and zoning send something out to the campground owners to be clear about what the intent of this is because you've got i know you've got a park i won't say where it is but you have a park now that i know is sort of actively allowing people to come in and stay as long as they want because in their mind because that park existed before 2017 they're allowed to have people indefinitely well let me let me say this this is the part i think that helps ke
» ep this a little cleaner is the registration of occupants and guests that is so important for you guys to do as owners and it's so important for us as the governing body to review and check that's your checks and balances and also inspectable by law enforcement or code enforcement so anybody here can what would be reviewed i mean what just the guests or i mean what what would they tell you if i have a i don't know i don't know what that would make it would be inspectable so your guest log or anyone that's there you would be required to have the names in the campsite of the occupants the license number of the rv and the dates of arrival and departure that would be inspectable by code enforcement or law enforcement and then there would have to be some if the if the ordinance was broken then t
» here would that would be code enforcement that would be madam this passes even with 12 months those those people that are that are living there only two months a year but keeping their rvs there continuously they would have to move their rv with you i agree that this language probably needs maybe it's not a time for right now but it does say remain in the park i certainly think that's something to explore between this reading and third reading because in some respects if a rv is being left unoccupied for a period of time at one point are you transmuting these parks to storage facilities somewhat they're different safety concerns uh you know unoccupied vehicles batteries gasoline left in them etc etc again some finer nuances to maybe look at but and one thing i think too is you know because
» i was the one who obviously put this on the agenda and i because you know mr renfro came to me and said hey this is a pretty tight time frame mentioned about the workers that's what started all this and so i want to be clear at least my intent in doing this was to sort of make it easier for businesses not harder so what i don't want to do is in making things and i think that's why mr brazil made his amendment i think all of us up here understand that you know what you say is fair i mean what you don't want to do is say well you know now you can't run the business that you bought because i know you bought this business fairly recently you know that you bought this business with a certain understanding and now we're changing the nature of the business whether we can legally do it is different
» than whether we should and so i want to make sure that that we are making it easier for businesses so i'm not proposed to make an amendment tonight but maybe and honestly to your point madam chair i mean i don't have an issue like i have heard no one complain about the rv part right like not a problem right i don't create a problem just to fix it so i'm not in favor of just totally unlimited yet because i think we could go there we could give it a year or two and a fa if it's still if you guys have that need we can always expand the problem if we say unlimited and then there's an issue expanding contracting expanding contracting that's going to make it so much harder on you guys to do business so i want to be do something that if we change this language to say that you know something about
» an occupied vehicle for nine months it would allow you to run the business the way you're running it the trailers could potentially stay i'm not so worried about it was it a storage unit i don't see that really being an issue because i do trust these folks to manage their businesses so i'm going to vote for your amendment mr rise i think it's a good amendment but but i would say probably between now and third reading which we'd have to do in writing it's probably a good idea to look at this look at the language mr renford move it down um that's a very uh what mr tucker brought up i had no idea you know you learn something new today you look at one law there's four laws that coincide with that but my take on that would be that wouldn't be on the campground owners if they didn't register thei
» r vehicles now to our point you know most of them are in south carolina already you know i have three residents of south carolina here working they just have to come here to get to kershaw county to get to these businesses quicker versus you know driving from spartanburg to here every day now i do have some from texas and whether that law is you know good or not that's not up for debate tonight but we do have a lot of outside workers coming in to keep our plants in the industry running around here um and i just want to make sure it's managed right and our county stays the way it is and they can stay longer they just can't set up residency so and that's the way the law reads so if you come here and and you're working from out of town i mean we have people up at the gold mine i mean they work
» 365 days well they don't work 365 days but they're employed 365 days a year they'll stay excuse me in one of the campgrounds um but they do basically what you're talking about when they get their five or six days off or take vacation they're gone for you know two weeks or three weeks and then they come back and they may not leave again for two months because they're trying to work and get overtime and get the job done and things of that nature so um that thing about registering your vehicle is only when you establish residence and that's what we're trying to make sure it doesn't happen that they don't establish residence uh without following the rest of the laws madam chair right thank you i'm just afraid that in our case i'm just having a hard time again i said that before telling people w
» ho just want to use our place for uh recreation telling them hey sorry after 12 months uh your time is all over you have to pull out i don't think that makes let me let me go yes sir we do understand we're listening uh mr kato is next so i i guess i have a question i grew up camping my whole childhood so i understand and traveled to many many uh campgrounds but i know if you go to some campgrounds um i'll use the mountains as an example you see a lot of the rvs that have turned into what looks to be a permanent residence there's porches put on them there's underpinning there's possibly bricked around the bottom what is the standard of your campgrounds as far as that's concerned because now that to me kind of changes the aspect from a campground to a to a permanent residence i mean we don't
» have a trailer there permanent setup i mean you can pull out any trailer there within 10 minutes 15 minutes absolutely there's no permanent setup without any wheels or anything nothing so if i may yes mr brasil i don't think our concerns necessarily with your campground our concerns is is keeping the county between the ditches right and i think my amendment allows you to do what you want to do it doesn't say you can't have a year and then another year behind it nowhere in the ordinance does it say that so is i think i think it accomplishes what you need it allows us to to stay in bounds within the law and i think it i think you're going to be happy with the results but if we talk about it all night we may decide to withdraw the amendment yeah i agree may i ask one quick is there an amount o
» f time in the ordinance that were that is required for the campgrounds to keep uh records of who stayed in the campground how long they stayed is that not i didn't see it in the ordinance when i was looking through it but that could be something so so if we have a year timeline um and we look back and you know somebody came back you know was going a month and then come back for another year um yes mr renfra so the fine line in law is always landlord tenant acts and the lodging establishment act title 45 and which would be under the rv all right and so bed breakfasts airbnbs campgrounds everything of that nature is under title 45 hotels motels restaurants boarding houses and if you read the verbiage campgrounds also fall under that category as well and that is uh how long timeline do you hav
» e to keep records okay so all records have to be years have to be kept for five years mr debose that it's just a guest registry it's not all the extra like tag numbers and all that stuff it's just a guest registry and if if if on third reading there was some desire to have a records retention period for this uh contemplated record you know one could be established whether it be two years three years okay um that would meet the requirements of it as mr renfra said he has separate record keeping requirements that aren't as granular for the county's enforcement purposes of the ordinance um as amended uh as proposed as amended and however it might occur on third reading yeah you could impose some period of retention for the specific records the county's going to require okay thank you mr debose
» thank you mr renfra gentlemen thank you so much i think this council is ready for the vote on this amendment and there's some things we're going to look at for a third reading i just want to quick input i think campgrounds that already started their business whether we believe it's right or wrong if you think from a business aspect those campgrounds i'm the only new one right uh but those campgrounds should be grandfathered under whatever they agreed to whenever they built and added their last addition here so if they haven't expanded they haven't changed anything i think they should be still grandfathered under the old ordinance because that's what they decided to you know that's what made them come here to begin with and invest their money likewise i put you know almost 200 000 in this sm
» all campground already and what's to say five years from now we'd go back and say you know what let's let's do it 30 days only richland county is doing that well then i invested my 200 000 for under the wrong premise here and so i want to make sure that we protect the campgrounds and the people that came before us uh to put their money here in this county and campgrounds are a big attribute to tax dollars in multiple ways and i don't want to take up all the time on that yes sir thank you thank you guys all right all those in favor of the amended motion to change nine cumulative or consecutive months per year to 12 months period indicate by raising your hand right and the vote is unanimous and now to the motion proposal to amend kershaw county south carolina unified code of zldr section 33.5
» as amended indicate by raising your hand all right this ordinance passes second reading on to third reading and gentlemen if you do want to add any provisions or language changes for that third reading we'll discuss that then thank you good discussions okay up to echo second reading of an ordinance by kershaw county approving a base lease and operating agreement by and between kershaw county as leaser and mount pisgah community and resource center a non-profit corporation duly organized under the laws of the state of south carolina as leasee and authorize the execution of the base lease and all other actions to effectuate the terms and conditions to the base lease is our motion at this time for this ordinance madam chair i'd make a motion that we move forward with uh the second reading of t
» his ordinance to enter into a lease agreement with the mount pisgah resource center okay mr kato makes a motion to approve and mr tucker the second yes right into discussion mr kato you have the floor uh there's there's we went through this on the first reading this is a very base lease agreement with the mount pisgah resource center um they are a non-profit organization that is using the um old mount pisgah elementary school um building up there and they're doing a fine job and they've um they've really started and done some great work up there already um so i think this will be a benefit not only to the mount pisgah community but also to kershaw county thank you sir mr tucker just ditto um i think they're really gotten themselves more organized now and um really moving forward on accompli
» shing their mission so um i think they've got a meeting coming up soon soon too mr kato but just keep us abreast and let us know what you need yes thank you mr kato for keeping us informed on this all right any other questions anything from legal yes sir yeah madam chair just a minor uh point of order the public hearing uh notice for this matter uh couldn't make the deadline for y'all's 26 meeting the public hearing and third reading will occur at the first october meeting just wanted everybody to be aware that it's going to skip a meeting doesn't mean y'all aren't considering it it's just falling off the agenda next meeting we'll be back on in october okay matter thank you it's a matter of timing okay all those in favor of the second reading of this ordinance approving a base lease and ope

» speak at the council meeting uh number five public comment is a time to speak on issues within the scope of council's authority and number eight the official record of the council meeting will only contain the names of the members of the public who spoke at the public comment agenda item okay a motion to update the public comment guidelines as indicated for a second second hey mr tucker with the second um and i just like to mr jones isn't here but mr tucker thank you for taking the time to look into this and um add these considerations into the guidelines so just correct me if i'm wrong a a person that is signs up to speak at public comments has to be physically here they have to sign up and be in person for their comment to go in the record and be part of our minutes yes you can still emai
» l be ready you can come down and speak and sign up like normal folks and that will be recorded into not what you say but your name will be recorded into as speaking in public comment i don't want someone to think because you come speak that we're going to have you written out verbatim what you say because madam clerk don't write out verbatim what we say and what we don't want to do is get into trying to translate what you say and then it's all misconstrued and we down a rabbit hole that none of us want to be under or not going down so these these are the reasons why these um amendments came madam chair and um i'm gonna ask for mr debose's opinion because it was read as a as it needed to be amended as the motion is that okay um to be clear madam chair and members of council um the proposed a

» re it with everybody and also disclose it to the public great to see our administrator a new attorney uh madam clerk and it's good to be among friends so i want to give you a couple of updates one of them will be particularly legislative it will be a uh house bill 4294 i'll talk about it last but it pertains to the fire mill which i spoke about so much when i served on county council you all were attuned to the fire mill issue and how you fund fire locally but first i'd like to talk about the funds that are coming back to kershaw county whenever i left council one of my main goals was figured out how to repatriate tax dollars back to kershaw county i'm just going to list a few of the items that we were able to get done so central carolina this is in the state's budget coming up we're lookin
» g at 10 million dollars coming to central carolina in kershaw county for health programs particularly nursing part of that's going to be in combination with musc but it's a great opportunity locally to improve uh 500 000 for the boat ramp there's been much ado about that boat ramp finally got that and it's awesome that the council also set aside a hundred thousand dollars uh to get that done i've connected um andy wicker who's an engineer for dnr with your administrator mr templar so that at any point if county council needs some assistance from dnr you've got that connection there he is the boat access engineer for the entire state and understands what's going on at the boat ramp at patriots landing and is ready to help there the fine arts center 500 000 primarily for ada compliance but al

» tly the local government fund there's been years in the past where the state legislature has punted on fully funding the local local government fund under the statute that's required it's a formula based on your population some years they just said we're not going to fund it and that's again repatriation bringing back the tax dollars that the citizens of kershaw county send to the state level local government fund was fully funded for fiscal year 22 23 at 2.675 million dollars and that increased by 3.7 percent we're looking at that increasing 23 24 to 2.779 million dollars so local government fund is fully funded and that's a big priority that we want to keep there um this is not just me it always takes a team effort as you know working on the the very serious issues that you do the kershaw
» county delegation particularly representatives mitchell wheeler newton senator mckelveen and senator gustason have assisted in these matters as well and taken the lead in various projects um or helped me where i needed it and i think they've all done a pretty good job uh representative yow also has been a great friend of kershaw county next thing i'd like to talk about is some of his efforts and and listening to us on various projects that were in kershaw county we got more than the lion's share that we were due from the ria or rural infrastructure authority okay the amount that you're most attuned to is 10 million dollars for sewer improvements i understand from the administrator that looks like you're going to be able to use that entire amount at your discretion for a 1 million gallon per
» day improvement for the sewer system that's on your current footprint won't require any uh additional real property and i think the facilities that you're going to acquire or install will allow for future expansion if you need it so all that's great in addition to that 10 million there's 10 million dollars to the city of camden for infrastructure improvements town of bethune bethune 478 642 casset water also received 10 million dollars that's going towards a 12 million dollar improvement project up towards the lake area and so that 10 is going directly there and so overall you're looking at about 43 million dollars plus that the state is sending back to kershaw county for infrastructure utility and various other projects that i just mentioned that's a huge win for us i'm really excited i do
» n't know that i can or we as a delegation can do that again next year because uh because i feel like we kind of knocked it out of the park um if you don't have any questions on any of that i'll move on to the legislative update any questions at all one question uh local government fund um what can we do with it or how can it help kershaw county well first it comes from the state's general fund and so it's general uh taxes that go into that group and then i'd defer to your administrator as to what he's used it for okay yes ma'am we that is something we consider every year is a revenue stream okay into our budget so that is that was a huge boost this year okay that's probably some of our dilemma each year because they don't normally fully fund it so it's a guessing game until the budgets pass
» yes sir and yes ma'am i can recall city council in the past where we said the local government fund formula says we will get x this year well when you get x minus 20 or 15 holy cow we gotta we gotta cut funding for um personnel or a vehicle that we're going to get and so it's very important that i think municipalities can rely on the state funding that under the statute and increasing it uh based on what we can do now next year is going to be a much tighter budget year for various reasons which i i won't get into the weeds here but it's going to be a tighter budget year but i encourage the county and anyone listening who has a has a basis of merit and even matching funds to say hey let's get some projects done in kershaw county and figure out how we can do it so i can make those submissions
» and bring dollars back to kershaw county all right last thing i'd like to give you a quick update on is house bill 4294 we talked about the fire mill so much just a real quick background on why that's an issue act 388 has a cap on millage increases generally but also for fire funding and so if you were a large county that already had an existing full-time fire service professionals fire service whenever um act 388 was passed you'd be fine because you already had your full-time personnel your hr which is your your highest cost built into your system so an incremental increase could cover hiring a couple more people if you need to of course kershaw county over the last number of years we moved from a completely volunteer system with a few full-time to full-time now professional fire service t
» hat costs a lot you have to hire a lot of people you have to get multiple shifts you have to have enough firemen show up at a at a site so that they have backup there are ratios that are required for safety if one goes in you got to have two out and you know if we had fire service here they could speak to those but you have to hire many people and that's one of the main costs when we looked at that funding i recall on council we couldn't do it under act 388 in the millage cap you weren't allowed to increase the millage to pay for that additional personnel so they had to do it by fees and ultimately i'm trying to shoot from the hip but i think it was like a hundred dollar fee pulling for improved parcel something like that um and if that's correct that would apply to an improved parcel which
» would be uh a one acre lot with a shack on it or some type of improved structure that counted under this under the code and it would also apply to a one acre lot with a five hundred thousand dollar house on it and so you can see the imbalance there you're paying a hundred dollars to have fire protect your you're barely there shack perhaps or one hundred dollars to protect a five hundred thousand dollar house with many rooms and protect perhaps other fire dangers and so that needed to be corrected and based on millage uh in in my view and as i recall much of the council's view at the time and so the bill that i've put up which has been referred to the ways and means committee and i anticipate we'll get a hearing next session and i'll keep you updated so you can interact with legislators you
» know to encourage them to support it and of course this is all at your discretion you don't have to do anything with it but you're going to have the option to do something with it if it does pass the house and if we can get it through the senate what it allows is one year from the date of passage a county council that has a population of 70 000 70 000 people or less can use a dollar for dollar reduction in fees exchange for fire mill so the fee that you have you can't build millage on top of it but you can replace it with millage okay so it applies fairly to the property that you have you have to wipe your fees out it's a one-time reset you don't get to do it again and that will allow for that more fair outcome we talked about where the size of your home the value of your home what it would
» actually take for fire service to service that if something bad did happen is more in line with what it would actually cost okay and so that's the quick and skinny on uh on house 4294 do you have any questions on that one at all mr tucker yes sir mr gone representative connell um so dollar for dollar we reduced the fee to the millage is there anything in that bill that stops future councils for assessing a fee down the road no okay it doesn't um and you could assess them say for example you anticipated doing another fee next year because of some you need a new fire truck i'm not sure you could account for that in the one-time millage increase but you couldn't do it again in the future you'd be subject to the cap right yeah i've got the trade-off but i'm just you know moving forward with the
» fee if that happens to be the way that a council decides it does not prevent a fee in the future if you needed to do it for some reason and you do realize we're pushing 70 000 now so you don't have much longer to get this pass right well it's it's based on the last census okay okay great if we need to adjust that language we can we may have to i have the state house staff look at it they said well based on the last census which is what they use population is uh 67 68 000 they said 70 000 was the number that uh that passed muster i need to bump that to 80.
» we may the idea though is the larger counties that already uh had this benefit under act 388 should not be able to reset their fire mill and do something crazy and and text their citizens there because they don't have the fee in place necessarily here we had to use the fee council had to use the fee in order to fund a full-time fireman that can service your house thank you all right any other questions at all i'd like to say thank you uh representative connell for all the work that you did on the boat ramp i really appreciate it the citizens appreciate it something that was overlooked for a long time thank you as i recall i think you you uh no pun intended drove the boat on that one made it much easier for me to work on it stay out we all did it as a team let me say and please take this bac
» k to you to your colleagues um i'm glad y'all don't have dc disease um our delegation here is a mixed group and y'all have put together what is best interest for the citizens of kershaw county and that means a lot because we do have representatives that are in different counties you know richland and then um and i know some of that's going to change the dynamics is going to change again next year but that goes to show that um we may all not have the same way of getting elected but we can all come to a common cause of doing right by the citizens and the people that we represent so kudos to you in that delegation and tell them we said thank you yes sir yes i echo that represent cannell are you the chairman of the delegation i am but that's kind of like being the uh the world's smallest talles
» t midget well thank you thank the delegation is near and dear to my heart so thank you for um bringing them together and and being here so i don't know if we need to do this quarterly or um twice a year or whenever whenever i guess i guess you could you two are in communication so just one example state and the local government can work together to figure something out it's now in your purview you'll have to figure out what do we want it to look like what safety features are going to be there what um i don't know if you do additional parking or if there's any number of different ways you could handle the project and work with dnr to make it happen but it was a vision that came together and we can do more like that in the future is the point if you have ideas let me know and then we can star
» t working on showing where there's merit and why it's justified and and why daggum that money should be spent in kershaw county as opposed to somewhere else if these dollars didn't come back to kershaw county you better believe we would be subsidizing someone else's project in some other county as we've done for so long so it's really important that we fight for bringing dollars back thank you yes sir thank you all right still in new business up to charlie council on aging generator and mr tucker i'm going to give you the floor absolutely discussion um like to make a motion that we approve funding for the santee lynch's regional council of governments in the amount of thirteen thousand four hundred and ninety five dollars to relocate the generator at the council on aging building here in ca
» mden south carolina kershaw county okay uh motion to approve the funding for the santee lynch's call for the replacement of the generator at the council of aging building is there a second second okay mr tomlinson seconds and into discussion mr tucker thank you as stated earlier this generator is there and paid for um it's located in a bad spot and not the proper spot and needs to be relocated um the funds have been identified at 13 495 by administrator mr danny templar um 2500 of that will come back from council on aging to be paid back to the county so to end up netting out where the county will be paying roughly ten thousand nine hundred and ninety five dollars would be the net cost um that money will come from a lion item transfer uh and i'll let mr templar explain exactly where he's wh
» ere he's taking that from please yes thank you um so with this money we will take this from our pnl property and liability insurance line we've already funded that uh cost for this year um and typically when we set up the budget we identify or project that figure so that figure came in slightly south of what we have projected so there's some residual funds there so we've identified that it will be of no impact to our current budget thank you mr templar so um with that being said and once again the the urgency on this is just we want to get this up disconnected reconnecting up and running for our um senior population and that takes something off the administrator and his staff um table or plate uh while we're going throughout storm season so this is real important uh to get done mr tucker do
» they have a generator right now yes ma'am okay it doesn't work it is working um right now okay it's going to be disconnected if we approve this though and then reconnected okay um i was just asking because the verbiage replaced so we're not getting a new one we're just no ma'am that's that's that's a that's a typo okay so since you're looking at it go down further the cog is not um ultimately reimbursed in the county either the council on aging is okay that was my next yes ma'am okay all right the council of and aging will reimburse hirshaw county twenty five hundred dollars okay and was um the original purchase of the generator was that our responsibility or that came from the cog that came from the cog it was funded through the cog um when we were having some extra grants and funds um the
» cog approved kershaw county council on aging out of fact we went through the region lee county sumpton county and clariton to assure that our le population had backup power due to any type of um you know natural disasters or storms okay all right any other questions all right thank you mr tucker for adding it tonight i knew i do know that they need the generator so um it's kind of expensive but i understand it's absolutely necessary not as expensive as a generator was but right all those in favor of the motion to approve the funding to the santee lynch's cog and the amount of thirteen thousand four hundred ninety five dollars for the generator of the council of agent building indicate by raising your hand all right and the vote is unanimous i'm sure if i may i just want to thank the adminis
» trator and the staff for being so kind and generous of locating the funds for us thank you mr templar all right up to old business so several um boards and commission appointments or nominations this evening for appointments we will start at alpha library board appointments so in your packet you do have the make it you do have the applicants also miss hannah has presented council with a list of applicants for all the boards and commissions there is one vacancy on the library board so at this time are there any nominations for the library board yes madam chair i would uh i'm always will i move to nominate mr dubose is that i believe you would nominate just nominate someone and then um and then i i'll say a little bit about who she is but i would nominate tiffany lee to the library board nomi
» nation for tiffany lee the library board right any other nominations how many do we have remind me again sorry just one opening one vacancy okay okay uh mr shimek do you want to tell us about miss lee so she is military spouse her husband served for years again military spouse former educator uh in the crucial county school system as well as others uh lives in the elgin area there is no uh member of district three on the library board uh part of my part of what i've been trying to do over these last several months is make sure there's a district three representative on each board someone who lives in district three on each board so uh miss lee would be the representative she's extremely passionate i've also discussed this with um miss scofield and miss scofield actually had a wonderful car
» she texted me today or yesterday and said she had a wonderful conversation with tiffany and she's very excited to have her aboard she's very excited to serve awesome i'd like to also speak on on her behalf she um she's a very socially conservative individual and um i like her ideas she she and i've had a lot of conversation in depth um and have traded a lot of texts so i'd certainly support her tonight i think it's a fantastic move right any other comments all right all those in favor of appointing miss tiffany lee to the library board indicate by raising your hand okay and the vote is unanimous congratulations miss lee excellent nomination she will do a great job all right next board board of zoning and appeals we have two vacancies okay mr shumate go ahead sir okay nomination for mr mark
» surrey for the board of zoning appeals okay any other nominations we have two vacancies okay mr shumate do you want to tell us about mr surrey and this nomination yeah so um mark surrey is also from elgin uh we just had a member uh gentleman from elgin benji strickland who rolled off because he moved and uh mark is someone who knows county government well mark uh for those you don't know was on our school board uh for multiple years and is very eager to get back into service for kershaw county uh so again his his knowledge of just overall government service and how kershaw county works will be particularly useful on a pretty important board as zoning becomes i think a pretty premier issue for this council so i think mark's going to do a fantastic job i would appreciate you guys supporting h
» is nomination all right any questions about mr surrey for the nomination okay all those in favor of appointing mr mark surrey to the board of zoning and appeals indicate by raising your hand right and the vote is unanimous congratulations mr surrey and thank you for your willingness to serve right we still have one vacancy on that board there are other applicants so just in the meantime between the next meeting i'll put that on the agenda for the next meeting again and everyone look through the applicants madam chair yes sir um so you're going to put it on the next if there's not if there's not a nomination tonight one reason i'm asking because if if we're looking for new volunteers it has to be in the agenda packet a council meeting before we vote on it so if you do that then you're going
» to eliminate new applicants if y'all following what i'm saying so the the application has to be in the agenda packet prior to the nomination it doesn't have to be one meeting before okay just prior to so as long as it's in the agenda packet of the same meeting and we've announced that we are going to fill the vacancy then we meet the rules mr debose correct me if i'm wrong correct i believe the rules simply state that it must be in an in an in an agenda prior to the appointment um i believe in my understanding um just from agenda review meetings as y'all have adopted this process of a heads up on the agenda prior to the appointment agenda so that council members can review perhaps the throws of applications that have come in over several months in other words it lets y'all know what appoint
» ments to review in advance but yeah it would be rule compliant as long as the application has been in some prior agenda it would be mr we can move it we can skip a meeting to allow time for that to happen yeah what i what i i just didn't want to exclude because i'm going to be actively looking for someone to fill one of these positions that that we don't fill tonight um and i don't want that to be the disqualification come next meeting that okay i'm just seeing this in my agenda pack package so um it doesn't qualify so that's why i'm trying to get clarity on how we're going to do it and what's what's our common practice because it has been in the past that it had to be a meeting prior to you voting right yeah so we dove into this pretty heavily um during our agenda review and so our rules s
» tate prior to the nomination it doesn't say one meeting prior and so since the agenda packet comes out on friday um that should give enough time each council member five days four to five days to review before they make the nomination so okay that was a way to speed it up and still be rule compliant okay thank you madam chair you're welcome all right charlie clean commission appointments we have six vacancies which judge hart is he left i was going to reassign him um okay at this time i'll take nominations for the clean commission clean community commission any nominations madam chair i have one yes sir i would like to nominate miss robin hayes from district six okay miss robin hayes from the clean community commission all right i would like to nominate mr tom webb the third for the clean c
» ommunity commission any other yes madam chair i i must confess i while i don't i know this uh young lady who applied i feel like this is a board that needs a lot of help and we have an applicant so i i would also nominate miss christine dennis who has applied for the clinic communities commission uh from and she's in uh district one okay miss christine dennis and how much total is that four of the six openings three of the six six vacancies also mr andrew whitaker um has also applied i believe he was in the same email as christine dennis and looked through and i've spoken with him uh seems like a a good applicant um i'd like to nominate him okay great nomination anybody else i'm overlooking miss christine dennis mr webb or what occur so that take care of the applicants that we currently hav
» e and i'll just put it out there we'll put this on the agenda again at the next meeting um and please if you're interested in the clean community commission um put in your application at the county website so for the clean community commission six vacancies filling for those vacancies miss robin hayes mr tom webb the third miss christine dennis and mr andrew whitaker okay all all those in favor of those four nominees to go on the clean community commission indicate by raising your hand all right the vote is unanimous congratulations to those four individuals and thank you so much for your willingness to serve mr webb thank you i see you on 97 all the time you have your own clean community commission all right up to delta old english district appointment i want to apologize to miss ricky goo
» d because there was some confusion on if this was the council's appointment or the delegation's appointment this is county council's appointment so at this time i'd like to nominate miss ricky good for the one vacancy on the old english district any other nominations okay um miss good has served on the old english district already she's done an outstanding job her heart and soul is in that position all right all those in favor of miss ricky good filling the one vacancy on the old english district commission indicate by raising your hand and the vote is unanimous congratulations miss good yes i was telling me uh last week about two boards that may or may not even exist anymore because they're just sort of in the dusty books they don't have any people on them so um these boards and commission
» s are extremely vital but only if we use them so i just want to thank you and miss parlor for the exhaustive work you guys thank you thank you yes miss parlor's working very hard on it all right up to item number 12 council briefings um and mr cato can we start with you tonight please well first of all i'm going to be brief tonight um but i i just want to i just want to express my appreciation to the community centers in in my district the ones the one in bethune and the one at mount pisgah um i've recently went through both of those those schools um and i can tell you that these people are working extremely hard to put these community centers together they're repainting they're bringing in outside outside uh agencies and entities to do things um to allow to allow things to come into their

» d like to welcome miss robin hayes to the clean commission and all of the people that are taking appointments but uh speaking for district six miss hayes she comes with a very very very um well defined resume she has a a lot of experience in a lot of different areas and so we welcome her and i look forward to working with her on that thank you thank you mr kato mr brazel i'd like to um reiterate what i said earlier i know there are a lot of economic development projects that are that are swirling around in south carolina and i just want to reiterate that kershaw county is open for business and uh looking forward to seeing what scout motors does that's pretty close by i'm sure we'll have some opportunities uh to pick up um some support businesses and we've got land available in three parks s
» o um just very excited for that thank you thank you mr brazel mr tucker yes yes madam madam chair um just briefly um miss hannah can you um make sure that we put the kirkland community center on the agenda for a presentation next meeting and i'll get you the information as the presenter and madam chair and um i would just like to say that um we did a little bit of housekeeping last night at the cog meeting we had an executive committee meeting and madam chair i would ask you and all our colleagues that we probably need to circle the wagons here on um doing our due diligence with our administrator that's all i would say on that so we can complete that before we get to the end of the year that concludes my report thank you you're welcome mr shumake yes thank you uh a couple of things first uh
» again thank you representative connell for coming i think that communication with our legislative delegation is critical also congratulations to uh tiffany lee and mark surrey um for their appointments to the library board and board of zoning appeals respectively as i mentioned before these boards are vital for the county to function um also congratulations to mr webb i wanted to thank you i haven't called you back but the uh mr webb is part of a philosophy group that meets in camden and i'm not able to make this week or i wasn't able to make the meeting or not able to make the meeting last week or this week but uh i do plan to attend one so thank you for the invite please let me know the next one um i wanted to also let everybody know that on september 18th which is a that's uh next week u
» h september 18th at the elgin library from five to six is a south carolina bar event called starting a business so it's basically a it's a one-hour class or sort of overview uh taught by members of the bar that uh to tell people about what to do to start a business i'm sure mr renfro and some of the folks in there can explain there's a lot of legal loopholes and they walk through some of that so it's at the elgin library september 18th from five to six p.m you can call and reserve a spot it's free but it's four three eight seven eight eight one and i'll be posting some stuff on social media about that also as to the folks who are here from the rv parks i wanted to say thanks again for coming in and talking um just so just so you guys understand where at least i'm coming from we have in kind
» of the time frame uh at the next meeting will be third reading i fully expect we'll have a written amendment before that um and one of the one of the things i think that written amendment will do likely again what i would propose of course is uh do something that would allow for the the unoccupied rvs to to potentially be there as long as they're not occupied so it would be something that wouldn't allow that wouldn't require that for the watery rv park folks wouldn't require you to change how you're doing business um and then again would probably put some limitation i don't think there'll be enough support for an unlimited um an unlimited stay but i think we can reevaluate that in the next year but we'll make sure to do something so we're not causing you guys to have to unroll the business
