» testing good afternoon i'm calling this kershaw county council special meeting on january 12th 2023 at 1 p.m to order mr cato will you lead us in an invocation please dear most kind and gracious heavenly father we just come to you today and we just thank you to heavenly father for giving us this opportunity to meet lord we thank you for giving us an opportunity to discuss the businesses of kershaw county and we pray that you would be with us throughout this meeting and throughout the upcoming year dear heavenly father just lead god and direct us in our decisions that it may best fit your will dear heavenly father lead god direct us throughout this meeting and throughout the rest of this week give us all of our sins which in christ's name we pray amen please remain standing for the pledge of

» allegiance all right is there a motion to adopt this special meeting agenda i'll make a mission and a second i'll second and any discussion on today's agenda okay all in favor of adopting this agenda mr cato mr tomlinson mr jones and myself with mr brazel and mr tucker absent next item on our agenda is an ordinance this is the second reading of an amended and restated ordinance by kershaw county council determining rules and order is there a motion on the floor pertaining to this ordinance i so move that we take this item up in a motion and a second i'll second and discussion yes madam chair if i may have the floor i have an amendment yes sir i'd like to put in place i would like to amend under article three section 3.1 item article one um that's back on now okay yep so section 3.1 budget o

» rdinance and millage ordinance that's correct under under item b um after title only i would like to insert shall be made as follows on second reading proposed amendments shall be made either verbally or by written motion verbal motions shall state with partic with particularity the proposed budget amendment and provide the source of funding for such expenditure written motions strike the comma shall be and then strike by written motion and then the rest remaining also item two on third reading proposed amendments may only be made in writing and shall be submitted as an agenda item pursuant to section 2.2 or section 2.3 under item three strike likewise and make capital m for motions in addition i would like to add under section 5.1 committees committees of county council under line item nin

» e after council members add as provided for section 3.1 b and then i would like to strike after so long such as strike motions and and and that is my amendment okay thank you mr tomlinson do we have a second on the proposed amendment second thank you mr brazil and let the record show mr brazil's here at 1303 and discussion on the proposed amendment mr tomlinson you have the floor yes um so my reason for doing this is is you know what we we want transparency um and we have to have on third reading in order to make an amendment has to the item has to be placed on the agenda in order to make that amendment this leaves us options for first reading and second reading during discussion we're allowed to make amendments verbally without having them placed on the agenda only for first reading and se

» cond reading however for second reading we have to identify a funding source if we're going to make you know we just can't make an amendment without having a funding source um so i believe this gives us a lot more option as a council to do our job thank you anyone else i don't have any issue with that at all um i'd like to see it in writing um do we have copies of the amendment it's the one in red well mr brazil's reviewing that part of the reason that i supported this proposed um ordinance to be changed like this is because there was a lack of transparency to the public so council members from their seat on any reading third reading could by motion change something that they did not give the public time to review contact them and then other council members sitting up here put them on the s

» pot to make a quick decision so that is the reason it was worded like that um so i do understand you want the flexibility on first and second reading but on third reading it will stay the same yep and that's exactly you know transparency which is a big part and and i really appreciate um your work madam chair for for putting it in like it was and um council member jones um and i feel this completely follows the transparency part uh we on third reading there will be no backdoor um amendments made it has to be placed on the agenda this just gives the fellow council members a lot more freedom on first reading and second reading to do their job for their district who they were elected to represent so this this continues this continues to protect us um against the trojan horse is that right on t

» hird reading yes and i think i can go along with it um there was one thing i noticed and and i i'd like while we're making amendments to at least consider i know we mr bradwell does it have to do with this i know we can talk about it later i'm sorry thank you okay let's finish this one then we'll we'll take any more mr cato yeah he can make an amendment to that amendment you can make it i don't need i don't need to make an amendment to his amendment something else in the gym okay mr cato anything on this specific amendment i have no comments okay just some issues mr debose this covers every and protects everything that i was trying to when i brought mine but before this kind of council of the last meeting this this amendment doesn't do anything to jeopardize what i was trying to accomplish

» as far as transparency and not ambushing us if anything this amendment probably bolsters the process um you know it requires that on third reading and final reading that everyone see the proposals in writing ahead of time so that they can review them digest them and more importantly so their constituents um have some awareness of the amendments and can provide feedback to their elected officials um it allows some more flexibility on first and second reading but again requires that any proposed amendment made verbally identify funding sources so they're not um for lack of better high in the sky yeah not ambushing or shooting from the hip yeah well i'm i'm i'm absolutely i think my first proposal was the best no i mean i'm not gonna lie i do i think it was the best but i'm gonna tell you some

» thing you guys have worked with me on this and this has been a working process and i may not particularly like it but i don't think it'd do any harm does that make sense i'm just trying to be straight with everybody but uh but but branch you put a lot of work into this and you called me yesterday to make sure that i was aware of what was going on you didn't want to blindside me up here no more than you none of us up here want to blindside the public as as they have been done in the past with the last county council um so and having the our legal advice our legal counsel tell us that you know it doesn't do anything to hinder or get in the way of what we're trying to accomplish here makes me feel a little bit better about it i'm just guys i'm just a stickler for making sure that and here's wh

» at i'd like to ask everybody to do and this is just me talking i'm going to support this because i know he has proposed this in good faith and he's trying to figure out what would be the best way to move forward with our agenda and our budget things like that but i would like to ask y'all to please whenever possible on second reading don't just unless it's just germane to a discussion we're having you know let's not pop up and have many surprises even though we will be able to do that let's just try not to do that out of respect for each other and and as i said i have all the respect in order that's how he's gained my trust on this because he called me he talked with me and he just said wait we got here and shoot something out and uh so having said that without prolonging i i'm going to sup

» port this okay all right i'll call for the vote on mr tomlinson's amendment to the ordinance all in favor mr cato mr tomlinson mr jones myself and mr brazel are there any other proposed amendments to the ordinance at this time i'd like to propose a small amendment yes mr brazel um and this this actually just within the last hour um came to me so i'll apologize in advance for for not speaking of it sooner but in section 2.5 order of business um proclamations are we limited to one proclamation per per meeting please i would ask that it be two and here's the reason why i would ask that we make an amendment to allow for two um i would hate for council members to have to put off recognizing someone um some of these things could be time sensitive i know we like to recognize our veterans and if sa

» y i have one and mr brazel i'm so sorry can you state your motion and then we'll go into discussion yeah my motion is to is to allow two proclamations instead of one up to yeah up to two yes not necessarily not necessarily any but up to two proclamations per meeting okay motion to amend section 2.5 f as in foxtrot proclamations by county council honoring a person or persons or an event or a matter of public interest as an agenda item are limited to up to two per meeting is there a second i'll second for discussion and discussion yeah meaning i may or may not support yeah that's fine mr brazel you have the floor i want to make sure mr browser gets on the floor to yes not much discussion needed i just i'd hate to come in here and need need to recognize someone and the next three agendas are a

» lready full and it could be a time sensitive situation with um with family members or um someone in the community that that may be um elderly and things can be sensitive to time so i just wouldn't want to hinder us from being able to honor someone that um i would like to honor or you would like to honor and i think one would hamstring us just a little bit potentially madam chair yes sir i have an amendment to his motion please okay my amendment would be that this county council would also have the authority to do a proclamation for an individual without bringing it to county council that the uh the chair and that council member could have uh staff do a proclamation up and they could present it to them i know that's done in a lot of places and uh but we could still have for those that we fee

» l needed brought before us um mr rose i might need your clarification because i think golf was put in for that reason proclamations may be issued not as an agenda item and not during county council meeting by individual council meetings i don't know if his i don't know that if his amendment will overrule my what what i had put his motion is pertaining to f and that is at a meeting i'm going to ask for legal's um advice madam chair um i think that uh you're you're reading um in this instance this is correct that can you speak into mic mr buzz i'm sorry madam chair i think you're reading um of that g provision is correct that um council members may issue proclamations outside of the context of a meeting and that f is more directed to agenda items on an actual public meeting so i i i think mr

» jones's concern um is contained within uh section g it is so would it be affected based on this would it be affected based on the motion that was just no sir we're talking about i'm talking to attorney please yeah i don't i don't yeah i don't think the amendment to f makes g uh eradicates g or um prevents g from operating if that's your question mr guys my question and i know you've answered mr bows if we go to allowing more than one proclamation per meeting which we've had for the last ten eight years and it has been a it has been a it can get it can get guys can get out of hand to some degree and that's what i'm saying you know we need to i mean i just go ahead and say it you got you know you have benches park benches for everybody in the inner city of camden i mean you know i just don't

» i want there to be substance and meaning behind these proclamations and these resolutions of course the council member can do whatever they want but i'm just saying the way i feel um so we can still do them outside of county council if we allow two and i think it didn't know what you're asking for at least two a maximum of two maximum of two yes sir okay yeah so again um a maximum of two at a meeting you know can certainly lead to um longer meetings mr jones is 100 correct on that um just like special presentations when they stack up can lengthen a meeting but um yeah the two the proposed amendment to um subsection f by councilman brazel um would not run afoul of what exists in subsection g i've been here 16 years and i think i've only i think i've only less than five resolutions that have

» i done you know not that that means anything but the ones that i've done were for specific reasons and i personally felt were very warranted and i know everybody up here feels the same way um just i just don't want to get back to how it was in the past but i tell you what one thing i will say is we never followed our rules in the past russell uh that was maybe unlimited three or four no it wasn't unlimited it was still two but it was so many came in and we just never and i'm guilty of it as well just didn't well we should do better we will follow the rules thank you thank you i'd just like for it to be too i understand i respect that if we could vote on my amendment my amendment alone i would appreciate that i'll call the vote um i'd like to weigh in on the discussion though you say your am

» endment and your amendment alone what are you talking about uh my amendment so i'd like to vote on my amendment that that has not been amended yet again because i don't think oh absolutely okay well i will tell you what i would do let's uh i would i won't have an amendment i would draw any amendment i was going to do thank you mr jones mr brazil have there been meetings that have two in the past well i think there have been meetings i've had possibly three or four every meeting every meeting okay mr jones just a second these rules moving forward if we after third reading vote on them and clear them they will be followed so we're not going to talk about the past or to the past if i need to but thank you any discussion mr tomlinson and mr kato i'm i'm completely in support of it i think it yo

» u know gives us the ability like to have two if we need be and two maximum i'm i'm perfectly fine with that okay and provision g still allows for any council member to do a proclamation individually they can do it in here not at a meeting all right i'll call for the vote could i could i ask for legal advice within this madam chair yes you have the floor okay uh me talking mr dubose if i'm mentioning the past and it's germane to the subject with resolutions proclamations am i out of order or is that is that correct um i do not know that you're out of order if your um debate on a topic um and your concerns about following rules and procedures prospectively um are born from past experiences and and you believe that's germane to um the discussion in other words um a desire to uh keep these stri

» ct and restricted to one which was the original draft i think is born from from your apparent past frustration so um it's yeah i think it's probably germane to that specific topic and the chair does have the right to certainly i guess all a point of order on me on that or if i am not i'm just i'm just trying to figure out correct as i understand your rules yeah i mean she did the chair rules on parliamentary uh matters with again the ability of people to refer to the county i feel listen i kind of feel about this the way i feel about my portrait being up on these walls yeah i don't want my portrait on the walls okay that is not germane to this conversation i didn't call point of order i was simply saying we're going to follow these rules i wanted to enter the discussion by saying we're foll

» owing these rules which i was i'm calling for a vote on mr brazil's amendment to change i want to restate it section 2.5 f proclamations by county council honoring a person or persons or an event or a matter of public interest as an agenda item are limited to up to two per meeting all in favor mr cato mr tomlinson mr jones myself and mr brazil the amendment passed thank you everyone any other amendments to the ordinance at this time okay i have one i would like to amend section 2.5 order of business a as in alpha the form of the agenda i would like to reorder the agenda to the following and add an agenda item for discussions number one call to order number two invocation number three pledge of allegiance number four adoption of the agenda number five proclamations number six public comments

» number seven public hearings number eight public presentations number nine approval of minutes number ten the addition of discussions and then starting at ordinances number 11 all the way through 18 at adjournment motion yes a second and we're into discussion any discussion on reordering the agenda items can we get a copy of that in writing it was a good little bit of changes there so so basically we're all we're doing is we're moving the public comment section down in the agenda and adding a discussion where new businesses so kind of so basically an example and correct me if i'm wrong would be like our council meeting two days ago when the discussion for the sewer authority and the architecture review board would then go under the discussion tab instead of new business yes okay so any item

» up to discussion so the thought behind the addition of discussions is to make sure old business and new business are voted on items that take action and discussion items are separated for clarity for ourselves in our own meeting but also the public and we don't have to distinguish so discussion items must be placed on just like i did in this past meeting correct as an item it still has to be on the agenda in the correct amount of time but it's just for an item for discussion and where no action will be taken correct and if you put an item on for discussion um you could discuss it how many times we could bring it up you could bring it up every meeting same same item right if you if you put it if you yeah if you put it on the agenda ahead of time and you need to discuss it several times so uh

» if you discuss something 50 we're gonna have um 24 meetings i guess it is maybe not christmas um so if you discuss something for for 20 meetings in a row and then you have a vote on the 21st meeting i think in the past in order to have a discussion we had to have a first and a second to to even bring up a discussion i'm lost i'm totally lost i'm sorry um i yield my time to mr jones so a discussion item so on our agenda tuesday for discussion only under new business that it won't have to clearly state for discussion only that will just go under a discussion tab we all know it's for discussion there won't be a motion or a vote taken we're just going to discuss whatever items council puts on that topic so i know in the past if we if we had to if we wanted to discuss something we had to make it

» in the form of a motion and when it was made in the form of a motion and we took a vote on it if it was voted down we couldn't even talk about it anymore we couldn't bring that that item up the point i'm trying to make here is um we may get some repetitive conversations that never take a vote which is fine by me um i've got a lot of things that i want to discuss too so i'm okay with the the concept and the rule change but i just kind of wanted to point that out and to make sure that made sense to everyone here um i would like to get a copy of it so we could he's making copy so i can i can better understand it before we vote if that's yes absolutely and mr debose i have a legal question if we add a agenda item to the form of the agenda do we also need to add something in this ordinance that

» clearly describes what a discussion item is and puts parameters in place for said discussion i don't know that that would be required but if it is the desire of counting council to make it very clear like the ordinance section the proclamations under e f and g um certainly at the prerogative of council if y'all want to get granular and clarify exactly what that discussion item section is for but it's not for matters that require a vote and the parameters of getting matters on to the discussion section yeah so if if y'all wanted to um propose language it wouldn't be out of order but i don't know that it is 100 required okay okay mr madam chair yes mr dunn's here i like the idea of having a discussion or a list an item on the agenda for discussion only it prevents us to as far as i'm concerne

» d is putting items on the agenda under new business which under new business you know you can quote require is there this is where we require votes and motions to take action for things to happen and so discussion only under new business i mean it may be i'm sure it's appropriate if we do it that way but i just don't think it's cleaning house enough i think having a line item says council members can place something on the agenda for discussion that they place it on the agenda their names under that item for discussion and we discuss it you know we can put the same thing on any agenda item every meeting every month for the whole year you know so i don't i that's that's where with all due respect that's that's what i mean when i lost what you were saying because i i just couldn't see where t

» hat to to me made any sense to me that somebody would literally just come in here and put something on the agenda for discussion twice a month for 12 for 12 months i think this is good i think it it keeps us in order to where we can't slip something and let me tell you nobody in here has not sitting here now has done that but that way we can't slip things on the agenda and under new business discussion only and uh try to make it something else than what it is not this specifically will clarify that this this is what is foreign it's on there's an agenda item uh i just think it's i think it's more it shows more clarity to me and i don't think there's too much room in there for a whole lot of abuse on that anybody wants to abuse discussion only they can abuse council briefings because we certa

» inly can rattle on about everything we want to say twice a month you know 12 months out of a year i i like this i do i think it's it's not a big deal i guess not a big huge change in what the way we do business but i've had council members in the past put put items on the agenda and they put on new business and then they say well i'm going to do discussion only i said well then you take it out of under new business because i think putting things under new business shows that we're planning to move forward with it in some fashion of taking action am i wrong on that mr dubose i think your understanding is correct that it can cause confusion if things are under new business so are yes matter for a vote so madam chair i i i will say i think this gives clarity and i certainly support it mr cato

» just just to clarify um it may i may be wrong but i in the past when something was placed on the agenda for discussion it required the motion and a second in order to be discussed is that correct it is kind of gray so if you put it like tuesday night when we put mr brazil put things on the agenda for discussion only we did not make a motion we did not take a vote we were simply discussing from the very beginning since he put it on the agenda he was given the floor to start the discussion i just wanted those items separated from business um because it's my understanding that business is an action that needs to be taken so it needs a motion to get into discussion and it needs a vote for the action to pass when you're discussing you don't necessarily well you don't you don't need an action as

» a result of the discussion and and i i i agree 100 with what you're saying i just wanted to clarify that it if we put this tab in here we would not need a motion and a second in order to discuss it correct if you want to discuss something in this council at a meeting you could put it on the agenda there and it would be a discussion with no vote and as long as the discussion stays germane to the topic we'll discuss it as long as everyone sitting here needs to thank you very much mr thompson anything all good mr brazil did that answer or clarify yeah i'm just trying to kind of get in my head i i think it makes sense so um under underline item 10 is where discussions will be and then new business will be at 11.

» so you couldn't you couldn't take a discussion and then add a new business it'd have to go on the next agenda it would according to these rules that makes perfect sense i just wanted to look at it madam chair i do would like what mr under the discussion now the myself i would have to put it on the agenda for discussion correct okay good good i just want to make sure that we just couldn't from our seat say okay i want to put this on there i want to make sure everybody understands that this is something that has to be placed on the agenda if we know we need a discussion about a certain item we place it on the agenda the public knows and we know you could a motion to change the agenda before the adoption to add something but yes ma'am you are correct but not just after we adopt the agenda if t

» here's no discussions on the agenda we're not going to discuss it unless it's business and we have a motion that gets a second and and mr dubose her her motion did clarify all that that it would be on the agenda by a council member correct okay i mean and and y'all's y'all's debate um has obviously discussed that um so yeah so the motion covers that that it has to be on the agenda by name and it's just for clarity i mean if that if you want that incorporated in your motion miss glenn you could certainly restate that um i know you reordered it and we've had some discussion i'm not to mr jones's point precisely um sure that the motion to reorder um incorporated this granular detail about the discussion item that it can be put on by one member doesn't need a second or any of that as it stands

» now any council member can put something on the agenda so i wouldn't think that that would need specific criteria it would be as if you were putting something on new business any any councilman can do it yeah did that answer no yeah i think we have we do there's we're maybe i'm i'm not understanding i don't think quite as well as everybody else says um i would like to amend the motion to state that under discussion which i support that madam chair has presented that it is required that the council member puts an item under that discussion item and their name that in other words they list what they wanted to talk about and they also list who put it on there i think that's what we're trying to achieve because this is not a council briefing if we have discussion and we don't have that that in

» it mr bows i think we just having an extra council briefing is what we'll end up having agreed that's my amendment i made that in the form of an amendment second second by mr brazil and any discussion on that amendment to the amendment and i just want to for clarity mr jones in a discussion item has to be put on the agenda ahead of time but also by the council person's name who placed it on the agenda yes that's what my amendment says no hiding right correct that's it that's it so for mr dubose is there a place in the ordinance that can add that or do i need to make a motion to add another section so um yeah i think the appropriate place to clarify the process for that um is probably within either two three or you could within the order a member of business clarify the method for the matter

» getting to the agenda but again that's a little out of order so i think within section um two three members of county council placing matters on the agenda which is precisely what we're talking about as an agenda as a discussion yes sir um the um clarification probably at the end of that first sentence um could state that uh discussion items shall be uh placed on the agenda in the name of the council member proposing said discussion item okay with that said i would like all items placed on the agenda to notate which council person put it on the agenda for business we do that but we we do that but i don't think i don't see it in here though she's correct on that yeah absolutely so um as a as a since we have layers of amendments at this point um the madam chair's uh motion could of course um

» amend mr jones's motion which amends the reordering or um and i could withdraw my amendment and let her just do the motion over correct at this time i withdraw my amendment if she'll do that thank you okay so i motion to amend my motion in the reorder of the form of the agenda in section 2.5 order of business to add item 10 for discussions to also add in section 2.3 that matters placed on the agenda will have a notation by which council person placed the item on the agenda under the listed item thank you mr jones is there a second second mr brazil seconds any discussion on the amended motion yes i want to just clarify yes mr jones sometimes it's a little slow i'm a little slow up here i know but um mr dubose so that will cover the fact that if any councilman puts something on for discussion

» they got to put it on the agenda in advance they got their name would be there and the item of which they plan to discuss yes councilman jones and further to um the chair's point uh if a council member wanted something on briefings or new business or any item that required action their name would likewise be beside that i understand that's been y'all's practice but this makes it a requirement i like that thank you members of council madam chair thank you gentlemen mr dubose just to clarify my motion since i amended my motion do we need to go back to the second amendment so he withdrew so now we're back to the top okay so i think the order of vote would be your motion to amend prior motion this addition of language in two three okay and then a vote on the the main motion um and i don't know

» if a um second was received on this motion to add the verbiage to two three i thought mr you may have mr brazil mr brazil my apologies i've got scribbled notes everywhere no one got deep all right okay so i will call for a vote on the amendment that we add the additional language in section 2.3 that the council person placing a matter on the agenda their name will be notated under the item that they place on the agenda all in favor mr cato mr tomlinson mr jones myself and mr brazil and now i will call for a vote to reorder the agenda items in section 2.5 and to add number 10 discussion items in accordance with section 2.3 all in favor mr brazil myself mr jones mr tomlinson and mr cato thank you legal and thank you gentlemen for getting through that any other proposed amendments for the ordi

» nance i'd like to propose an amendment yes sir mr brazil the public comment guidelines i i noticed it doesn't have any um any time frame at all other than than everyone gets five minutes um i know we were worried about the meetings getting too long with the multiple proclamations and that sort of thing and i can certainly understand that um would we like to limit it to one hour for public comment um that would that would certainly be a lot of input and a lot of time for us to to take notes and and make sure that we we get back to everyone um mr brazil do you have a motion that that that is my motion that that we make it in in a maximum of one hour okay mr brazil's motion is to amend appendix 3 to add a maximum for public comment guidelines of one hour is there a second i'll give a second fo

» r discussion all right in discussion on the amendment on the amendment mr brazil my apologies i tend to always go into discussion thank you for keeping me straight um i just think it could get it could get long and i think an hour is is generous and um you know i'm okay with five minutes um i think that's a reasonable amount of time for someone to have a grievance um we certainly want to hear from everyone but um the nights do tend to get long so with that any any other comments i may yes mr i don't trying to remember we've once in a while we've had some long public comment meetings but i don't know that we've ever gone over an hour do you ever remember going over an hour danny if i may no sir not under the current yeah we got a maximum 30 minutes that we've done away with we're saying that

» five minutes per person no matter how many people come in um that's the way it works now under what we've got correct there's no time limit correct yeah there's no time limit um within the four corners of this proposed ordinance and i believe there wasn't a time limit in the prior if i'm not mistaken it was 30 minutes 30 minutes so the the number of speakers which that's what we wanted to get away from you know thank you so the part of the reason the 30 minutes i advocated it for it to be removed was if you're preparing to speak in front of county council which i have done i think you guys all know and you come in and you're told you have a minute or two minutes it can throw you off especially if you've prepared something the amount of public speakers that prepare five minutes i think is lo

» w but by removing a time period it ensures the public has the time that they were prepared to speak if they need it they know what to expect when they get here and it's not changed on them on the fly it's also easier to maintain timeliness that way i've asked legal to give them a four minute warning and then they need to close it up and they will be done speaking at five minutes so yeah i wouldn't want to shorten the five minutes um i think if anything maybe uh it'd be appropriate to to have a maximum i just i know some other folks had these same concerns so if someone wants to second it second it if not then we can rock and roll well you you mr tomlinson seconded um mr jones in your experience on county council um what is the highest number of speakers you've seen or you can remember well

» i've seen 350 400 people standing here in support of me and well maybe not always in support of me but most of the times signed up for public speaking yeah signed up for public speaking um i think the most i've ever seen was what 18 that was once or twice do you remember we went over 20 um once but it was for a dollar general and then but i think to your point it came down to 18 because several people spoke consistently on a subject and truncated it down yes and they and they they didn't get five minutes right so no that i would i would definitely want everybody to get five minutes i would not want to take anything away from anybody let me say this if i may if i may miss madam chair there's no question in my mind i understand what mr brazil's saying i may not agree with it because i think i

» i just would like to make sure everybody's got five minutes but i know he cares about public having their time to speak i know that just because i may not support your uh motion but i do understand that and then there's absolutely dialogue for both sides of debate for both sides but um i'm gonna probably stand with the five minutes per person i think it simplifies it it guarantees everybody has five minutes and we'll see where it goes i do know that the removing that limit will make the meetings go longer especially if there's something controversial um it's my belief that i need to sit here until that last person gets to say what they came in here to say so i would like to not have a maximum in appendix three we can always revisit it next year when we review the rules also number three in

» appendix three does state if a group would like to speak we request that a spokesperson be selected so i can reiterate that if there is a hot topic or several people here to speak on one item one thing madam chief one thing i would like and i think you're you're going to do this that we keep order in in in this council session that we don't that we go by the rules i have to follow the rules everybody else has to follow the rules and uh you know and that the rules be read before each starting of the uh public section speaking i think all of you understand what i'm saying we just we just need to make sure we have order law and order in here and uh i'll say that to all my friends and all my uh constituents and all my enemies out there this what was it they said in the past all the thousands of

» people that are watching okay but anyway whether it's a hundred or a thousand we got to have law and order here we got to take control of this room i'm not going to i will from this point i will not as long as i'm sitting in this county council allow somebody to come in here and take over this meeting it's not going to happen i may not agree with her him him or him but we run this meeting and you can come in here and be angry with me all you want i'll sit there and listen to you but you're not going to take over our meetings thank you you know what i agree with um i agree with madam chair that if if there are um if there are issues that that need to be heard that we do need to listen to the public and i'm fine with that um i just noticed there was zero time limit so i wanted everybody to be

» aware that if if we get a hot topic meeting we might be here to midnight we might be here to one or two a.m so and i'm willing to do that it's uh it's just something i wanted to point out and clarify so with that being stated i withdraw my motion right the motion's been withdrawn thank you for the discussion gentlemen all right with that we are to we're up to the vote of the second reading correct mr dubose yeah if there are no further motions to amend yes madam chair y'all are calling for a vote on the second reading of this ordinance as amended as amended at this time i will call for a vote to approve the ordinance as amended amended and restated ordinance by kershaw county council determining rules and order of business all in favor mr cato mr tomlinson mr jones myself and all opposed we

» 're in favor mr brazil i was i didn't see your hand i'm sorry mr brazil in favor sorry yep and the ordinance passes second reading and we are to adjournment is there a motion to adjourn so moved and a second second any discussion i i would like to say one thing on behalf of myself to to the members of this county council i just want to say that listen we had some discussion today we didn't all agree coming in here and we all had our issues that we wanted to address but i have to say it is a pleasure to be working with a leader sitting next to me it's a pleasure being working with a leader sitting over there and you two folks here as well now we can have our knockdown drag outs but i like the way we conducted it nothing was taken personal and i just want to say that it's a breath of fresh ai

» r for me after 16 years i hope it stays this way thank you thank you sir and i call the vote on motion to adjourn all in favor mr brazil myself mr jones mr tomlinson and mr cato
