Full meeting transcript - March 22, 2022

Machine transcript of the county's live stream. Each » marks a change of speaker; the captions don't say who is talking, and names are often misspelled. For the readable version see the recap; the official record is the county's minutes.

» test one two test bring it up there if you would please sir okay are we hot yes we are on the mic that's a great day in kershaw county uh we just finished uh at the springtime right ritual of county cleanup thanks to the mayors the school system uh the department of transportation danny templer and the swan family and judge hardest and all the clean community people what a great day it is we're getting ready for the Carolina Cup and the county will look great. I hope we can stay that way. We also started springtime sports with a dog fest this weekend and Lugolf Elgin has 50 years of softball tonight for the girls and that was just terrific and the reason I mention that it's National Women's History Month.

» This is a time when we should remember that 50 years ago the Congress and the state agreed that we should have women's sports and look what's happened in 50 years we've had a softball team that went to state championship the usc baseball excuse me basketball is going to go all the way again hopefully this year and our own softball as i said went to state champs and so it's a time to celebrate women in the sports but also women who are professionals my own family is chock full of women like that a doctor the national champion cross-country racer and a special forces lieutenant colonel in um and the sof and i don't know what she does but she does something really cool um also i want to thank mr connell mr brazel and mr gardner for the time they spent and will spend on the ad hoc committee on

» their first round we the people uh mean that we are kind of a we the people kind of country where the great american pronoun is we we do it together dialogue is not disagreement and it's not disrespect and so mr connell presided over the messy middle here last week and i thank you all three of you for your help there and with that i'd like you all to join me in a moment of silence for our friends and and who are teaching us a meaning of liberty and freedom as we learned in a revolution 240 some odd years ago please uh please stand with me and let's hold a moment of silence let us pray dear lord thank you for the example in the book where it says blessed is the nation whose god is the lord and may that blessing and and uh guidance remain with us and the people of ukraine carry us through thi

Thank you. I pledge allegiance. Thank you very much. I would point out to you someone vital is missing today. To the left of Mr. Jones is normally Mary, which I believe she's listening in.

» Danny, is that correct? All right, Mary, we hope you have a quick recovery and thank you for your professionalism and working from home to support this this group and the important proceedings we have here uh with that we go to you mr dubose tell us what you got we're now moving into public comments and i remind you all that these comments are not a q a or question and answer uh keep it on topic of business that relates to the mission of this county council and i also ask you to maintain a decorum in this body so that we may conduct the business of the people here mr dubose mr chairman one person signed up and that person is tommy swan oh great good evening councilman and mr chairman so thank you for any of you or all of you who participated in the cleanup this past saturday i understand th

» ere's going to be continued activities in the upcoming days and just want to appreciate all the effort of everyone to get out there and and help get the county ready for the carolina cup i'm looking forward to that today i'm just coming here to give you an update on the good all friends and upcoming events that we're going to be holding uh the good off the friends of good all state park was created as a joint effort typical of what the parks uh south carolina prt asked us to do as a as a community to join with them and just help with the beautification and operations of our parks so we formed this group locally here in kershaw county it's called the friends of good all state park so our current status we've one we've gone ahead and we filed for the south carolina friends status and we've cr

» eated a seven member group board and we've also requested it to be a non-profit organization with the secretary of the state and also file the necessary documents with the irs so that we can be a 501c3 and solicit donations upcoming events this coming saturday we're going to have our first annual spring clean and spring clean 2022 and And this is gonna be an initiative where we're gonna join with the park rangers. They're gonna send some people over from Sesquy and some of the other parks to work on the waterfront of Goodall State Park, right where the spillway is, just to give you better access for fishing. And if you like to fish or you have grandkids that come out there, it'd be a good opportunity at some point to teach 'em all about the park.

» We need volunteers to help haul whatever the park rangers, whatever they cut down. They're the ones that are authorized to use the chainsaws, and we can't, but we could use manpower. We could use hand tools and things like that. Our job will be to take what they cut, take it to a trailer, and then take it to the landfill and haul it off and get as much cleaned up as we can. We'll be starting at the spillway and working our way all the way towards Stagecoach Road. And this is our first joint effort that we've had, and I think it's an excellent opportunity to demonstrate that we're serious about the park, we care about the park, the citizens care about the park, and we're not just gonna dump it all in their laps to tell them to fix it. We're gonna put some skin in it as well.

» So there'll be, we need equipment, some hand tools, no gas tools, of course. We will have free hot dogs and refreshments. will ask that you limit the number of hot dogs to four and uh of course we will be taking up donations we will be taking up donations of course to cover any expenses of us filing for the all the necessary document and covering the food and all that way we'd like for everyone just to join in join goodall state park so that it can be the place to go for for now and for generations to come and if you'd like to join the friends group send an email to [email protected] or join the facebook group friends of goodall state park and tell others about the friends group so i was looking through some old photos and everything and i'm going to wrap it up because i kno

» w we're going to schedule here i found this picture right here anybody notice this guy with arrows pointing to it he's got real skinny legs but i believe that's julian burns right now this was taken about 1960 in the archive photos but uh of course i when i started going in i did like other guys did i went there for the girls but they don't allow swimming anymore but they got great canoeing so for the community of kershaw county here's your chance come join us this coming saturday at nine o'clock from nine o'clock to one thirty we'll take any time that you're willing to uh devote to that thank you thank you well done thank you mr devose mr chairman that concludes the sign up list and with that we move into the adoption of the agenda it's uh it's up on the screen i believe yep there it is so

» with that can i have a motion to approve a question to approve the agenda mr tucker a second second uh for mr gardner i hope mary's getting all this any discussion uh with that we move to vote all those in favor so signify unanimous and we move to the next item uh on which is the approval of minutes dated march 8th it's at tab a and it's on the screen it's at page two in your electronic books can we have motion to approve the minutes so move uh mr gardner a second second uh mr tucker any discussion uh none i would say that during that discussion we had a robot team here and it was kind of an agreement that we would bring them back and discuss a donation and you'll see that in the agenda that we come up to next since there's no further discussion we move to a vote all those in favor signify

» and it's unanimous again and so we moved to new business item number one which is a kershaw county robotics team and when mr jones made a little idea last time i thought we would give you the honor of of making the motion mr mr jones thank you mr chairman members of county council i make a motion to appropriate three three thousand five hundred dollars to the kershaw county robotics team by transferring appropriate appropriated funds with the condition that the funds be used by the kershaw county robotics team for the trip to the national championship and verified as used for the trip thank you very much a second please mr brazel yeah second thank you very much uh with that it's on the table jimmy go ahead please well as we had discussed you know this is an academic team and uh these kids h

» ave worked very hard and i think there's no question in my mind we've got the money there to do it and i uh would just like to see this council pass this let's move forward thank you sir uh mr brazel well i missed the last meeting in person sorry i was tuned in uh via telephone sorry i was not here to see all the the members of the team but congratulations for making it it's a huge achievement and and this is a national event so i'm in favor of supporting it and uh hope the money helps and gets you guys where you need to go and hope that you're very successful uh other comments so i couldn't bring them forward would you rather sammy go ahead um my question is mr jones um i know you've had close contact with this group um in the past will this make it where they're they're now set to go or w

» ill they still be short mr tucker good question and uh let me just jimmy i can have them come up if you want we can but let me let me just say this one thing i can tell you is that they are 1400 away from their goal they have no incidental money whatsoever and i think this is a very small amount to give to an academic program for these kids to go and be able to you know do their thing in houston now now of course as i said you know they will verify the use of all the monies i'm not questioning that i'm just making sure that you know they don't still have a long way to go to get to yes this should really help them and pretty i think pretty well get them set on the right path but let me say this too that you know the school district has appropriated money for them and as i said it is academic

» and uh i think it's well worthwhile to do thank you and i think it's a very little bit of money compared to how much we normally spend in this stop i will if we're ready we can bring the team forward or ben you want you make a comment yeah just one comment so beyond it being really cool for the demonstration last time it also lines up with the county's goals in relation to workforce development i do believe with what we've done at central carolina with what we've done with woolard tech and employers demanding in in the market mechatronics and that type of skill set i mean this lines right up with it so it's awesome that these kids are starting young with some really neat technology Thank You mr. chairman mr.

» Tuck I want to thank you very much for working with me on this throughout the past couple of weeks I know we've had a tough time getting back and forth with each other but uh I just appreciate your advice as well yeah thanks everybody thank you I would say that I've been working with this team for several years and when with Frank Morgan and now with Mr.

» Robbins and my company and I have both given substantial money to this organization and I'll tell you the reason it's just what Ben said the mission of this organization and I'll just read it is to transform our culture by creating a world where science and technology are celebrated and where young people dream of becoming science and technology leaders this is a part of an FIRST program that I've supported not here in the county but out in the national level and that means for inspiration and recognition of science and technology and that means workforce development for Kershaw County. I wanted to read something to you from the Secretary of Commerce.

» Dear Chairman Burns, congratulations to the robotics team and best of luck in the national nationals i love that competition kershaw strong harry leitze that's from the secretary of commerce and he's working with us right now for workforce development and bringing new business to kershaw county that thing sends a signal that we are into the 21st century we understand what brings business which is great students and great teachers and great parents with that sir uh can you come up and i'll have mr snodgrass ask him questions but just to the microphone yeah go ahead mr snodgrass just a couple questions mr.

» administrator and again I think this is a good idea so in my questions I'm not I'm not trying to speak negative but what budget will this will this pull from and then how do we how will they procure the funds is it a as they expend them reimbursement or what's going to be the method we'd provide a check to the school district I believe and then the school district would provide the support okay so we're simply just reimbursing the school district and okay good nothing's a good thing you know I'm thinking back this is probably the modern-day version of you know back in the you know back in the 60s when when it was first we were studying rocketry and I'm reminded of the of the movie October sky in which Homer Hick Homer Hickam and his friends are sent to the state science fair as well as a na

» tional fair to to display their rocket so these these coal mining boys you know I love the irony you know just the the the um uh the picture there of those who are under the ground expiring for above the ground but um i see this as for generations now communities have always supported this realm and has always supported you know their students uh to be able to go to the next thing so who knows uh we we may have the next warner von braun or homer hickam or or you know next scientist in this group and you know we were a part of you know being able to help them get get to that next level so thank you any other comments sir anything from the team may work Kershaw County Robotics is grateful for anything that you guys are able to do to help us we believe that we've nailed the the amount that we'

» ve got since but we've never been to Houston Championship before so the amount that you're giving us will I think enable us to go and we don't think we'll need anything else after that as far as I know we just haven't we've nailed all the expenses that we know of. We just don't really have anything set aside for incidentals yet, and part of this will help, you know, part of your funding for us will go to that if we need to use it, and we'll report it back to you. Yeah, Jimmy, go ahead. Mr. Terry, thank you so much for all you do. You've been with this group for quite a while. Could they stand up? You got a few of them here tonight, don't you? Yeah, we do.

» We're going to have them come in up here in a minute yeah we're very proud of these kids absolutely uh i think we're ready for a vote and if you don't mind we'll do a quick picture all right uh though all those in favor signify by raising your hand and mary would you record that as unanimous would you bring the team up so we can thank them i'm going to make a correction i said uh national champion here in the in the pamphlet it says world championship yeah it's awesome that was an honor thank you very much and as they leave i'm gonna hey sheriff thanks for coming tonight appreciate seeing you here buddy uh item number two in a new business is procedures for the baileyville implementation it's at tab b and there it is on the screen and in your electronic books is a package on page five uh i

» believe we're going to introduce this for discussion and not for vote but i turn to mr connell sir you have the con yes mr chairman i make a motion that we introduce this for discussion only at this time can we have a second second and mr snodgrass mary uh with that ben i turn to you sir thank you mr chairman it's a brief recap this is an opportunity to allow people to pay less taxes on historically developed properties something that is generally over 50 years old they can freeze the property tax rate on that for up to 20 years so what you have in the packet is just a framework we're not voting on it tonight i anticipate after refining the language some more to introduce it for first reading uh at the next meeting but i really appreciate staff and the accountability of doing exactly what w

» e say we ask the audience to be quiet please uh tommy i ask you to calm it down thank you go ahead ben i really appreciate staff doing exactly what we asked and bringing this back to us within the required number of meetings um i think it's just a great opportunity um a few comments then a couple questions for staff i understand camden has had this in place for a while and they experienced two to three bailey bill applications per year so it's not a real heavy load um they don't have a particular cost when we ask them what's the cost associated with that they just said it's it's some limited staff time to review and a question for mr debose so there's an entity at the state level correct that does verification or preliminary verification of whether or not a property counts mr connell in a n

» utshell to a extent you can put something complicated in a nutshell which is what we're doing but yes you do an application and we have a standard application incidentally this application and ordinance is patterned after Lancaster counties they have an ordinance so it's patterned after theirs but yes you get an application and then the key word is you have to have a reviewing authority somebody has to review the application and the scope of work to determine in their opinion that it's eligible and we in this ordinance defer to the South Carolina Department of Archives and History or to a municipality in the event they have a reviewing authority. So, yes, it would go to the South Carolina Department of Archives and History, but the package has to be put together to be sent to them.

» I've talked to people and they say if you send them a package and it's incomplete, they just send it back and say it's incomplete. So, you have to have someone that knows nuts and bolts of how to put the application together, Mr. Connell. send it to them and they recommend it or don't recommend it but the state ultimately has an entity after we send a package over if there is an application yeah and then for for council members few other things we need to consider as it comes up for first reading is term do you want it to be 20 years or five years or 10 or 15.

» we started for what man for the period of the uh tax rate being fixed so again the idea is on the front end you have a derelict or rundown historic property that you want to have improved um or if it is improved in the community you can freeze the tax rate prior to it being reassessed after it's assessed they pay that that pre-improvement tax rate for a period of time so it can be substantial tax savings over a period of time the term is one thing we got to look at the issues i'd like to us to consider and i'm still trying to research and figure out myself is you know we have grandfathered and non-conforming conditions and exceptions or approvals for people who have a code passed on them when they're in the midst of doing something or they already have it used in a particular way um i'd lik

» e to see if something like that applies here like prior to a property being reassessed can you still qualify for the tax savings because on the books you still have the the lower property tax amount still trying to figure that out with legal counsel um and those are all the comments and questions i had at this time mr chairman still a lot of work to do thank you i've kind of made what i'm doing uh gentlemen is keeping a list of where your concerns are because the staff will have to come back on each of these and hopefully mary is hearing these as well and that will reflect a staff report if you guys understand where i'm taking this discussion if you have an issue we'll make sure we got them all down and then the staff will come back as ben has suggested who had the second was that you uh da

» vid go ahead thank you mr chair uh members of council i i like this i like the direction we're going with this uh i think this helps us create a diverse uh system in which we you know we feed into developing our commercial side of our business and we do it in a way that it's accessible uh to to mom and pops to to really anyone who wants to invest in historic property we've had discussions on this council about you know quote unquote tax breaks or you know what everyone call it to to big business and we've you know we've talked about uh we're about mom and pop well this is this is the mechanism this is the mechanism in which we are able to to give those benefits in fact this is coming to us the the constituents that have brought this to at least my attention are are your local business owner

» are the people who yeah they're not going to drop 10 million to 10 million or 15 million dollars into a project it's gonna be a lot less but they're the ones that are bringing this to our attention so that they can continue to rehab and develop our historic buildings that we don't necessarily want to lose their their they're there's those buildings tell stories they build character and but we just want to rehab them so I like the direction that it's going mr. mr.

» de bose is there would it be legal so let's say I want to make application for to get in a Bailey bill are we the county able to then charge a fee for that for that work that would need to be done in order for in order for my property to on the on that list yes and the ordinance says you would set the fee every year in your budget okay all right so because i recognize this is going to put a strain on staff this is going to take time and so i mean i think it's only it's only fair that is me me as the consumer you know that i pay whatever fee helps cover you know staffing and whatnot and then are we able then to would a first step be able to give reciprocity to municipalities that already in our county that already have this like could that be a first step of kind of wading into this water uh

» for example the city of canada already has all this in place they have their their committee and all that are we able to as a first step give begin to give reciprocity to to those properties the ordinance says that as mr connell has articulated that archive partner archive does it for the unincorporated areas and the incorporated areas that do not have a reviewing authority camden has a reviewing authority so yes you can defer to them and it's not i'm not willing to say you could not answer it's about grandfathering well i think it's a matter of qualifying for the work you're doing that's that's the operative word viewing authority says it's historic and the reviewing authority says the work that you're doing is qualified well it's easier to qualify something in advance than it is retrospec

» tively because it's just a matter of then a documentation right right okay thank you can i ask i want to interject real quick jimmy on one point of clarification you said we're following the lancaster county model in this particular construction all right yeah with some modifications okay uh but in particular to that the reviewing agency is archives in colombia yes and specific to that that means we don't need to set up a commission on our own but has anyone checked with the archives in columbia to see if they're willing to do such a thing for us with state state law says you can designate them and will they accept us without cost or with cost we need to notify them because i've been told it's a matter of giving them the information in correct form that's top on my list to have the staff co

» me back to it jimmy i'm sorry i interrupted you sir no no no that's that's quite all right i actually uh you've all said things that i have concerns about as well too i am all for preservation of old buildings i think it's great but let me tell you something i want to know how much is it going to cost us to implement the program i wonder how much is it going to cost the taxpayers to implement the program and i want to know just what kind of a burden will it be putting on our current administration and and you know with planning and zoning already complaints that i'm receiving on them for the work the overwork not conforming getting out there in time to to to do certain things i don't think we put any more on top of them i think we're moving a little bit too quick i'd like to see us slow dow

» n and let staff come back to us mr chairman members of council and present us with a way that they're going to handle this and their recommendation as to how much it's going to cost as well because we have no clue right now at those issues that i just brought up i just wanted i just want my questions answered about how we're going to run it and uh we we camden's it appears that camden is pretty well set up for it i guess with their reviewing authority or whatever they have but we don't i want the same equal concept for kershaw county that the city gets i want to make sure that we're providing lugov antioch kershaw excuse me um well kershaw county but uh bethune and all those areas i want mount pisgah i'll make sure they have the same ability that we're going to be working with the city of c

» amden on as well and and we don't right now that has not been set up so we've got to get that set up and i just want to make sure that just like the the boutique hotel i think we moved too fast on that and we saw what happened i don't want to move too fast on this till we uh absolutely um get the questions answered as far as how it's going to run and and i'd like to ask mr carpenter do you have a plan in motion to implement this now so there is no plan to as far as implementation well that's a big that's a to me that's a big problem and i think it's unfair to staff for us to fast track this on one two three readings at the next council meeting i think we need to wait let staff come back make a recommendation to us and answer the questions explain to us just how is this going to be done and

» be done fairly throughout the entire kershaw county thank you good points um other comments i'm going to add a few um i think jimmy i can i can copy what you just said as tell us what the plan is and what the process is and uh i would like also we implicit to this discussion here is coordination with the city of camden because there's a there's an interface here and secondly implicit is coordination with the town of elgin and Bethune. So those are my other two. Mr. DeVos, tell me in the construct here, I've read it and I'm asking you to tell us what it is, the role of Kershaw County Council once we approve it, if we approve it. Tell me what our role would be and say I've got an outhouse on Highway 97 that's 150 years old.

» What do you do? You have to take the application, the application's in here, proposed application has to be filled out. The supporting information has to be with the application. The application is then sent in the case of the unincorporated area of Kershaw County and Elgin and Bethune, as we now speak, sent to archives. They review it. They make a recommendation. Then you have to approve the recommendation, but they would come back with a recommendation that it qualifies. The building qualifies and the improvements qualify.

» The rehabilitations and no his rehabilitation qualifies that's what they would come back and tell you for vote do we take a vote yes you would have to approve it okay is that understood everybody to some degree it still doesn't tell me what the administrator's role is in this and and there is no plan in place to handle it and we don't run the county we don't run the projects the county administrator runs the projects for us so to for us to sit here and and and even think that we might be running this program we'll certainly approve different things that are requested to us but bottom line is the administrator runs the county the administrator will be overseeing this for us and we'll be making decisions but the administrator would be handling it so therefore the administrator needs a plan an

» d i don't want to put our administrator in quicksand or even planning a zoning or anybody else that isn't ready and this has been thoroughly discussed invented as far as simple questions what is our plan to implement what is that process going to be good I'm not saying excuse me that's why we're having this discussion to get that plan yeah yeah but you you got it on the next week that I mean the next two weeks that I've had on anything I was just saying this is I don't put anything on the agenda okay good wait I'm glad you're so concerned about staff now mr. Jones thank you very much I want to apologize to the preacher or interrupted me while I was talking um but Mr. DuBose relax take a deep breath okay count to 10 sir let's go ahead sir please excuse me I got the floor and I will Mr.

» Chairman thank you for your courtesy tonight on letting me speak but bottom line guys why would you get upset or why would anybody be upset just because I want questions as to how much is it going to cost taxpayers I want questions how will we implement it you know the facts just just the facts and THAT'S SOMETHING THAT OUR ADMINISTRATOR NEEDS TO COME BACK TO US WITH. BUT I DON'T THINK WE'VE ASKED HIM TO DO THAT. HAVE WE ASKED YOU TO DO THAT? NO, SIR, NOT TO THAT DEGREE. OKAY. WHAT I WAS GOING TO DO, JIMMY, AS I SAID, IS I WAS GOING TO LIST WHAT I THOUGHT I HEARD EVERYBODY SAY, AND THAT WILL TURN INTO WHAT WE WANT THE STAFF TO DO, AND THAT ADMINISTRATOR, OF COURSE, WILL DO THAT. THANK YOU, MR. CHAIRMAN, MEMBERS OF THE COUNTY COUNCIL. THANK YOU, SIR. LET'S NOT AGGRESS ANYTHING FURTHER.

» ALL RIGHT. more issue and i think i do um there are some people who would ask us to make this retroactive items already in progress what's the ruling on that i think it's possible that it goes down to having the reviewing authority approve it i keep saying that okay the reviewing authority has to approve the work and if the work has already been done or started or started it makes it more difficult for the reviewing authority i'm not saying it's impossible but most most jurisdictions like it to be done in advance so they'll know what's going on you've already torn the building down you've already improved it but if you have photographs if you have documentation yes it's possible yeah mr. yes sir mr.

» I just want to clear something on that thought when it comes down to retroactive that's another slippery slope as well because what when you're gonna cut retroactive off is it going to be two years is it going to be three years is it going to be five years you see what i'm saying so i'm just i'm just putting that out for discussion because um i like the project and what we're trying to do but i don't i don't want to create a headache and a nightmare for none of us and um and i want to cover as many people as possible but we have no problem with them doing some more upkeep to their house and applying for it yeah mr chairman uh now go ahead mr connell i'm sorry ben yeah i'm just a couple points um mr jones has some very good questions i'm concerned also about cost and how it may impact staff

» the only data point i've been able to get so far is that city of camden gets two or three applications per year and it is such a minimal cost and burden for them that they they didn't even attribute a dollar figure to it um in talking to staff so far up to this point no one asking if it's a bad idea or a good idea or what no one said hold on you know put the brakes on on this is terrible we don't need to do it in kershaw county um and that's why this isn't first reading tonight so that we can still figure out some of these questions uh mr tucker that's a very good question as well so i don't think in this circumstance it'd be appropriate to draw a line in the sand and say it's two years or three years or anything like that i think what's more appropriate is has the property been reassessed

» yet or assessed based on the improvements if it hasn't then it's still in this in this limbo phase of improvement of historic property with the project being ongoing if that makes sense so if the property hadn't been like if it was just got completed three months ago and it's on the books as is some new number then that'd be very problematic how are you gonna do that that bells already been rung but and that's why I mentioned non-conforming or grandfathered type efforts or rules that we have because whenever you maybe this should have been in five years ago or four years ago or however long ago so people could save on tax calls but i've only learned about it recently for whatever reason and so here we are and whenever you spring uh or replace a new opportunity or code uh on someone the peop

» le who are in the midst of it prior to assessment you know i personally would feel kind of bad saying well you don't get a benefit from it um your property hasn't been reassessed yet you're in this limbo phase and we've we've sprung this opportunity on you but you're not going to benefit so that's one of the things I'm trying to research further to see if is it you know prior to being put in use I think it's certainly prior to it being assessed based on improved value I hope that answers some of those questions it does and I'm and I'm more speaking of you know I've I've come through a re a renovation with my home and I followed all the steps for the historic site that I'm working on reassessments hit as well like it just did last year and now we're doing this but i'm only maybe 18 months 24

» months into mine will i qualify will i not um with those circumstances everything i've needed to do is done i'm not in the middle of anything i've i've did my renovations and i've been reassessed where do i stand is your building over 50 years old yes then you might be able to qualify i mean potentially it depends i would say it depends on on the permit uh if the work being completed it's not works being done are we in order mr devos point of order are we in order with the discussion yeah yeah we're talking about exactly about how this might apply yeah it's a hypothetical well i mean it's real for you but hypothetical whether or not you'd be approved so if the if you're saying the permit that you pulled all the work's already been completed i don't know that's a tougher call that's a much t

» ougher question but those are the kind of right that's why i'm having this dialogue yeah that's a much tougher call if the work's already been completed all the way i'm going to interject here and that gets to the next issue of standards is what qualifies as historic and so there's not just old it's historic and that's the review board process and that's why it goes to in this case the the archives bureau up in colombia you see so that's the next piece but what we're doing is presupposing a hypothetical but it's very important that the standards and i don't know if you all have had a chance to read the standards but in addition to being old it's got to have certain standards of criteria and i think mr dubois is doing a good job of capturing those i ask you all to take a look at those and i'

» m going to write that down as one of my issues again other comments uh just me right over there quickly i don't know that we go ahead mr go ahead well first off i don't know that we can put all that on the attorney i don't can we or can we not well i can i'll tell you what the variables are right now okay the variables are the fee that's the variable fee you charge you can set it every year change it every year obviously it goes in effect prior to july 1 you're going to have to set it in the ordinance with the ability to change it number two is the term as mr connell said can't be over 20 years number three is the amount of improvements can be anywhere from 20 to 100 of the pre pre-value and then next is the reviewing authority in this case it's archives with the unincorporated area but you

» can set up your own reviewing authority like the city's done although i will say a lot of counties use the um archives and then mechanically getting the process in place of how you're going to get the application and get it over to them and that's what we don't have yet yeah and i think ben condell did a great job coming to us tonight with information he's helped me a lot i'm not against this guys i just don't have my questions answered as to how much and how we are yeah other comments mr chairman i was going to bring up one thing so mr tucker had a great example i guess of what he's experiencing right now but the good thing is say that a renovation came up in two to five years or something like that where you need to do it well it would apply for you and anyone else that could qualify that

» had a historic property over 50 years old um and i think correct me we did that study in o203 that identified like a thousand properties that were outside of the city of camden those would those would qualify yet is that wrong yes you could you could designate that study if we haven't done it here but you could do that yeah i mean as a baseline we've already done work a long time ago to identify a bunch of them and they've only gotten older so we know that those are still uh approved there's a group over that period of time that have aged in to qualification um where it gets tricky though mr connell is they were approved in that condition so assuming some of them have been extensively renovated the question would be does the renovation change the character i mean that's an issue mr chair ye

» ah and that's what ben just stated makes my point exactly this could be a nightmare for staff if we don't get it right i mean you come with thousands property or whatever that may already i mean we just need to have a process in place we need to know how we're going to do it and we need to how much it's going to cost us and what kind of a burden it's going to put on ourself and when i say how much it's going to cost us it all goes back to the taxpayer so bottom line is i don't i just want my questions answered and with that i want to call the question by reading back and y'all listen what i think i heard from each of you and mary will capture all these and pass them to the administrator for answering staff burden was the first thing process that's jimmy time to act on this in terms of speed

» of moving through this process cooperation and coordination with camden elgin and bethune as the other three municipalities that all have a piece of this the role of kershaw county council and standards which are the fee the amount and the reviewing authority at the historic archives uh retroactive yes or no and these are all the questions that have to come back we don't need to have them answered tonight the term and very helpfully introduced by ben the cost jimmy uh reviewing authority and coordination with them to make sure they're agreeable and plan to implement i think i got most of your comments i think that's 75 percent of that were my concern thanks jimmy anybody else i'll give a copy of this to ben i mean excuse me to vic to pass on to mary uh i'll just close this by saying history

» makes us stronger us and kershaw county have got a magnificent history of pain and triumph and i believe we're the most historic county in the state and even charleston can't brag on what we've done so i will tell you with that with the rev war and the revolutionary war in the inland port and all the things that have happened in this county bernard baruch our great indian uh trademark uh king haggler mr kershaw on and on and on this is a great place and then this might help us celebrate our county with that i'm ready to go forward and no vote is required i believe and with that we move to the next item in the agenda if you'll bring that up um which is council briefings uh over to you sir mr brazel keep it quick um we've talked about a lot of good things today and i appreciate everyone's com

» ments and concerns we've missed one very important thing today is an important day in south carolina especially kershaw county as it is the opening day of turkey season oh no when we're here so i've got all my camouflage in honor of that day so everyone be safe and good honey that's all i have oh man thank you mr chairman um the ad hoc ad hoc growth committee meeting um went very well The next scheduled date is April 18th, 2022 at 6 p.m. and it'll be in the county facilities here. I'd like to thank Mr. Brazel, Mr. Garner for participating and for all the discussion that occurred and all the other people assisting.

» I really appreciated the presentation on Goodall State Park, Pine Creek Golf Course, which the golf course there came under new ownership in that same neck of the woods, roughly. They had a big tournament over there and I'd love to see that area of the county continue to grow and develop. That's all I had, Mr. Chairman. Thank you. Yeah, Mr. Jones. Thank you, Mr. Chairman. Just a couple of things right quickly. One, Mr. Carpenter, when is the date? I don't have it in front of me that you're going to come back with the request we had for planning and zoning. I believe we said in April, maybe the 12th or the 26th. I just want to make sure we've got that on course. And I think the last I heard, y'all, the ad hoc committee was up to 11 people, I think, that the chairman appointed.

» But I just want to make sure that the notes and boasts is what I presented with the comprehensive plan with your getting involved, bringing us back. Some type of recommendation is vital. I think it is vital that we move on that as quick as possible. Stay on task with that, sir, if you can, please. Yes, sir. I've got some comments I want to say, too, about Bobby Swan. He came up here and he spoke tonight on the Goodall State Park. I want to say thank you. Thank you so much. Judge Harts, thank you. I learned how to swim in that park, and it means a lot to all of us, no matter where you live in this county. Goodall State Park does.

» So regardless of how we, I know there's a lot we've got to do, a lot of work y'all have to do, but I just want to tell you, both of you and anybody else who sits with you, that I really appreciate it. Regardless of the outcome, I appreciate the hard work y'all put into it, and I think it's a good thing for our community. And when I say community, I mean our entire county, West Watery as well, Elgin, all of the above. So thank you so much.

» and again i want to say thank you to the council for working with the robotics team as i know everybody was eager to do what a what a great thing for these kids but anyway other than uh that's it mr chairman thank you sir uh mr stargrass mr chairman members of council uh just i'll try to keep it brief as well uh uh judge hardest tommy swan thank y'all thank you so much for coming and tommy thank you for your words uh when after soon after i was uh elected to district five uh good all state park was one of those things that were part of you know one of the priorities that i wanted to talk about you know and quickly begin to meet with then senator shaheen and representative funderberg and then you know thanks with your guys help we've had the audience of prt director uh we've had the audience

» of the actual parks director and then we've formed the relationship with that rangers and so it's really neat seeing uh seeing that very first meeting that we had where we went out there just to just to remind ourselves of this great treasure and and it you guys took it where it needed to go we had to get it out of the hands of not so much to the hands of the government because we know that that could slow it down but it got in the hands of the citizens and and Tommy you know having your passion throughout that thing forward I really really appreciate that and so it's good to see it's good to see three plus years years of of work on our part of making sure that the right people uh have their right attention on it because i think that was our concern our concern was hey this this park this p

» robably has been forgotten and and ever since we've started those conversations uh we've seen more rangers out there they've staffed it better and and uh so i thank you thank you guys about that um and also real quick just there's some just make everybody aware i just learned a little bit ago from from Danny they're doing some some sidewalk repair the DOT is out there in East Camden as well as possibly some resurfacing so we're I'm hoping to keep in that conversation with them to make sure that again like I said last week or the last meeting sometimes government is a little inefficient in which the right hand doesn't know what the left hand is doing and and so we've had we've had DOT headquarters tell us that we have drainage issues and now they're going to try to go do some resurfacing so

» I appreciate Danny even though it was just quickly today but making sure that they're aware of those conversations that we've had in the past and and as well as that they're aware that there's a study that's that's currently being done on that corridor so we'll just I'll keep I'll keep you guys on abreast on that so thanks Sammy Thank You mr. chairman members of council I want to start off by just telling mr.

» is roads um they have now agreed that they have not given us a new road in 23 years in the westwater east section absolutely unacceptable i've made that clear in a series of condos correspondence i'm wearing out the typewriter and they've gone to a new model bin which is called small wins so they're going to start feeding back some victories for us and i would say they're small indeed but at least it's some progress not good enough also i've got a letter from uh general sheriff leon lott a brigadier writing me back as a quote general uh saying thank you for the opportunity to let his palmetto guard as you know he's the commanding general of the palmetto guard which is an augmentation to the national guard for the opportunity for the state guard to participate in the great irish fest event a

» nd i would also tell you if you see uh miss o'hara becca o'hara and her team uh thanked them for what they did at that irish fest it was a great event but i did want you to know that we've been getting recognition and lastly i wish you a safe trip after a seven years of working with you you're finally taking a vacation so i wish you a safe trip over to you mr Administrator. Please. Chair, members, council, just one item to brag about today. This afternoon at our detention center, we had a graduation of our six-member GED class in cooperation with the Kershaw County Adult Education. These six men persevered.

» They got their diplomas today, and when they finish their time, they will be able to go and be gainfully employed and start their is over with a fresh start so kudos to director cato his staff uh to mr wayland burns from adult education and uh their their teacher their instructor miss sabrina awkward uh who's an amazing teacher if you've not had a chance to talk to her she'll get you excited about doing anything that's my thank you sir i met the chairman i have nothing and now i miss love you too mr tucker mr tucker do you have a notion to do a motion i make a motion to expose this meeting to adjourn thank you can we have a second second mr garner any discussion i was wanting to just comment to the administrator on the program but we moved so quickly i wasn't able to get your attention coul

» d i say something yeah please okay uh let me just say this as the former jail administrator i am in full agreement when you can let someone get a basic ged what i am not in favor of is inmates getting college degrees while incarcerated but i think cut back cut down on the revolving door things like that are necessary and i actually worked on that myself when i was with the county thank you mr carpenter for making sure and to our jail director for making sure that runs well thank you i close the meeting with a vote all those in favor so signify mary is unanimous and we are
